•1 W I T N E S S E T H: <br /> 2 WHEREAS, Site Approval SA-01-52, was approved by the San <br /> 3 Joaquin County Planning Commission on November 15, 2001, for the <br /> 4 subdivision or development of land on the hereinafter described <br /> 5 property with certain conditions of approval which require an <br /> 6 Irrevocable Offer to Dedicate a 4-foot-wide strip on Thornton Road. <br /> 7 NOW, THEREFORE, for and in consideration of the approval of <br /> 8 Site Approval SA-01-52 , it is agreed by and between the parties hereto <br /> 9 as follows : <br /> 10 1 . OWNERS represent and warrant that they are, the fee title OWNERS <br /> 11 of the land described in Exhibit "A" , which is attached hereto <br /> 12 and incorporated herein. <br /> 13 2 . OWNERS agree to convey to COUNTY fee title interest free and <br /> clear of all taxes, liens, encumbrances and assessments within <br /> 15 ninety (90) days after written request for the same is made by <br /> 16 COUNTY of the land described in Exhibit "B" , which is attached <br /> 17 hereto and incorporated herein. Said land is to be used as a <br /> 18 public roadway. <br /> 19 3 .
