1 NOW, THEREFORE, for and in consideration of the approval of Major Subdivision <br /> Application No. PA-08-134, it is agreed by and between the parties hereto as follows: <br /> 3 1. OWNER represents and warrants that it is the fee title OWNER of the land <br /> 4 described in Exhibit "A", which is attached hereto and incorporated herein. <br /> 5 2. OWNER agrees to convey to COUNTY fee title interest free and clear of all taxes, <br /> 6 liens, encumbrances and assessments within ninety (90) days after written request <br /> 7 for the same is made by COUNTY of the land described in Exhibit "B", which is <br /> 8 attached hereto and incorporated herein. Said land is to be used as a public <br /> 9 roadway. <br /> 10 3.
