1 WITNESSETH: <br /> 2 WHEREAS, Site Approval Application No. PA-04-364 was approved by the San <br /> 3 Joaquin County Community Development Department on November 2, 2004, for the <br /> 4 subdivision or development of land on the hereinafter described property with certain <br /> 5 conditions of approval which require an Irrevocable Offer to Dedicate the following: <br /> 6 ■ 50-foot wide strips on Payne Avenue, Concord Avenue, Mayette Avenue and <br /> 7 Placentia Avenue, including turnarounds and 30-foot by 30-foot corner cut- <br /> 8 offs <br /> 9 ■ a 25-foot wide strip on Wildwood Road <br /> 10 ■ a 50-foot wide strip along the west line of Parcel 1 described in Exhibit "A", <br /> 11 including a 30-foot by 30-foot corner cut-off <br /> 12 ■ a 50-foot wide strip along the center of Parcel 1 described in Exhibit "A", <br /> 13 including 30-foot by 30-foot corner cut-offs <br /> 14 ■ a 25-foot wide strip along the east line of Parcel 1 described in Exhibit "A", <br /> 15 including 30-foot by 30-foot corner cut-offs <br /> 16 The above-referenced lands being described in Exhibit "B" and shown on Exhibit "C" <br /> 17 NOW, THEREFORE, for and in consideration of the approval of Site Approval <br /> 18 Application No. PA-04-364, it is agreed by and between the parties hereto as follows: <br /> 19 1. OWNER represents and warrants that it is the fee title OWNER of the land <br /> 20 described in Exhibit "A", which is attached hereto and incorporated herein. <br /> 21 2. OWNER agrees to convey to COUNTY fee title interest free and clear of all taxes, <br /> 22 liens, encumbrances and assessments within ninety (90) days after written request <br /> 23 for the same is made by COUNTY of the lands described in Exhibit "B", which is <br /> 24 attached hereto and incorporated herein.
