herein permitted or which may arise out orthe failure of the part of the Permittee to properly perforrn the <br />work provided under tills permit In t1:leevent any claim of such liability is made agaillst the Cmmty of San Joaquin or any depari::ment,. <br />official or employee 'thereof,the Permittee shall defend,inderimify,and hold each of them harmless for such claim. <br />.10.All backfill material is to be moistened as necessary and thoroughly compacted with mechaniyal means.'Ifrequired by the County Director <br />of Public Works,such backfill shall consist of gravel or crushed rock..The PeImittee shall maintain the surface over siructures placed <br />hereunder as may be necessary to insure the return of the roadway to a completely stable condition and until relieved of such responsibility <br />by the County Department of Public Works.Wherever a.grave1,crushed rock at asphalt surface is-removed or damaged in the course of <br />work related to the permitted encroachment,such material shall either be separately stored and replaced in the roadway as nearly as <br />possible in its original stafe or shall be replaced in kind,and the road"WaYshill be left in at least as good a conmtioil as it \Vas berore the <br />commencement of operations of placing the encroachment structure. <br />11.\Vhenever it becomes necessary to seCTJIepern:ilssion from abutlli,g property O'iVIlerSfor the proposed work,such authority must be see-ured <br />by the Permittee prior to s'"Lfu-tIngwork. <br />12.The current and future safety and convenience of me traveling public shall be given every'consideration in the location and ~eth:Jds ofconstructionutilized. <br />13.The Pennittee is responsible for the preservation of Sllil'ey monuments located "Within~ilie &rea of work herem permitted.Prior to tb.~start <br />of construction,survey monUffients m8-tpotentially may be disturbed shall be located and referenced by a Licensed Land Su...-veyor,and a <br />Comer Record filed with the County Slil--veyor.Any Sm-vey Monuments disturbed during the course of construction shall be reeshblished <br />by a Licensed Lmd Surveyor and anoIDer Comer Record filed -with the County Surveyor.(Laud SUi"veyors'Act Section 8771) <br />14.p.rior to..any excavation,the Permittee shall notifY USA North.(Underground Service Alert of Northern California and Nevada)at 811
