<br />2.It is understood and agreed by the Permit'"eeethat the performance of any work under this peDD.it shall constitute an acceptfmce of ill the

<br />Except as otherwise provided for public agencies and franchise holders,this permit is revocable on five days notice.
<br />3..A..llwork shall be done subject to the supervision of and the satisfaction of the grrntor.The Permittee shall at all times dth-mg the progress-
<br />of the work keep the County Highway in as neat and ~lean condition as is possibl:::-and upon completion of the work authorizeu hereiu,
<br />shall leave the County Highway in a thoroughly neat,clean and usable condition.
<br />4.The Permittee"also agrees bytbe acceptance ofiliis permit to properly maintain any encroachment structure-placed by the Permittee on 8...'1Y
<br />part of the County RJ,g]lway and to immediately repair any damage to any portion oime high'W8.Y,which occurs as a result of the
<br />maintenance of me said eilcroachment structure,until such time as the Permittee may be relieved of me responsibility for such mainteilallCe
<br />by the County of San Joaquln.
<br />5.The Permittee also agrees bytbe acceptance of this permit to make,.at its oVrTI expense,such repairs as may'be deemed necessary by the
<br />County Department ofPubITc Works.

<br />6.It is further agreed by the Permit'-tee that whenever construction,reconstruction.QI maintenanc~work upon the highway is necessa.y,the
<br />installation provided for herein shall,upon request of the County Depa.rtment of Public Works,be immediately moved or removed by and
<br />at the sale expense of the Permittee.
<br />7.No material used for fill or bacldill in the construction of the encroachment shall be-borrowed or taken from Vt'ithin the COUIlty right orv,ray.
<br />-g.All work shall b~plauned and cfu-ned out with as little incoItvemence as possible to the traveling public.No material shall be stacked

<br />9.The Permittee,by the acceptance of this permit.,shall assume full responsibility for all liability fur personal injury or damage to propeIT)'
<br />which may ,arise out of the work herein permitted or which may arise out ofibe failure ofibe part ofllie Permittee to properly perform the
<br />work provided under this permit In the event any clillm of such liability is made against the County of San Joaquin or any department,
<br />official or employee thereof,the Permittee shall defend,inde:nin1."Y,and hold each of them harmless for such claim.
<br />.10.All baclcfill material is to be moistened as necessary and thoroughly compacted with mecha.ulcal means.Ifrequired by the Co'unty Director
<br />of Public Works,such bacldill shall consist of gravel or crushed rock.The Permittee shall maintain the surface over structures placed
<br />hereunder as ID2.Y be necessary to insure the retlh-u of the roadway to a completely s'"t.ablecondition and until relieved of such responsibility
<br />by the County Department of Public Works.YVherever a gravel,crushed rock or asphalt surface is removed or damaged it,the course of
<br />work related to the permitted e=t.croachm.ent,such material shall either be separately stored and replaced in the roadwilY as nearly as
<br />possible in its original staL"'eor shall be replaced in kind,and the roadway shall be left in at least as good a cond'ition as it was before the
<br />GODll-Uencement of operations ofplacmg the encroachment structure.
<br />11."Whenever it becomes necessary to secure permission from abutfmg property O'i:vJ1ersfor the proposed work,such authority must be see-ured

<br />12.The current and future safety and convemeilce of me traveling public shall be given evelY "consideration in the location and memods of
<br />construction utilized.
<br />13.The PeImittee is responsible fur me preservation of survey monuments locafed within the area of 'work herein per:n:ritled.Prior to the start
<br />of consiructiou,survey IDOlllli:ncnts that'Rpteilually may be disturbed shill be located and referenced by a Licensed Land Slli.-.,reyor,and a
<br />Comer Record filed "nth the County Sili-veyoL ArJ.y8m'vey Monuments distorbed dur:ingthe course of construcDon shall be reests.blished
<br />by a Licensed Lsnd Surveyor and another Comer Record filed \Vith the County Surveyo~.(Lmd SUi-veyors'Act Section 8771)
<br />14.Prior to .any excavation,me Permittee shall notify USA North (Underground Service Alert ofNorfuem California and Nevada)at 811 or
<br />800-227-2600 forty-eight (48)hoUrs in advance.
