understood and agreed by the Permittee that the performance of any work urrder this permit shall constitute an acceptance of.all me <br />provisions contained herein and failure OIl.the Permittee's partto comply with any provi-sion vriJl be cause for revocation of this permit. <br />Except as o1herwise prqvided for public agencies and franchise holders,this permit is revocable on five days notice. <br />All work shall be done subject to the SL'Penrision of and the satisfaction of the grantor.):be PeIill.ittee shall at all times during the progress- <br />of the work keep the County Highway in as neat and clean condition as is possible and upon completion of me work authorized herein., <br />shall leave the County Highway in a thoroughly neat,clean and usable con~1iDn. <br />The Permittee'alsD ,agrees by the acceptance of this permit to properly maintain any encroachment structure-placed by the Pennittee on 8....TlY <br />part of me CDunty Higpway and to immediately repair any damage to any portion oime highway,which occurs as a result ofllie <br />maintenance of the said encroachment structure,until such time as the Permittee may be relieved of the respoIlSibility for such maintenance <br />by the County of San Joaqu5n. <br />The Permittee also agrees by the acceptance of this pemllt to rna..lee,.at its ovm.expense,such repairs as may-be deemed necessaI}'by the <br />Cmmty Department of Public Works. <br />It is further agreed by the Permittee that whenever construction,reconstructioll'.or maintenance work'upon the -highway is necessary,the <br />installation provided for herein shall,upon request of the CDunty Department DrPublic Works,be immediately mDved or removed by and <br />at the sole expense of the Permittee. <br />No material used ror fill or backf111 in the construction or the encroachment shall be borrowed or taken from withiu the COUIlty rig.ht of <br />"vay. <br />All work shall be planned and cfu-ned out wt-th as little inconvenience as pDssible to the traveling public.No material shaH be stacked <br />within eight feet (8')of the edge oftbe pavement or traveled way unless otherwise provided herein.Adequate provision shall be mad.e for <br />The protection of the traveling public.Traffic:con.trol standards "shall be utilized iuclllding barric:ades;approved signs 8Ild lights;and <br />flagmen,as required by the particular work in progress .. <br />The Permittee,by the acceptance or this permit,shall asSIlJ.--nefull responsibility for all liability for personal injury or damage to property <br />which may arise out of the work herein permitted or which may arise out of the failure of the part of me Permittee to properly perform the <br />work provided under this permit.In tlle event any claim of such liability is made against the County of San Joaquin or any department, <br />official or employee thereat the Permittee shall defend,indemnify,and hold each of them harmless for such clailll. <br />All backfill material is to be moistened as necessary and thoroughly compacted vn.th mechanical means.Ifrequired by the County Director <br />of Public WDrks,such backfill shall consist of gravel or crushed rock The Permittee shall maintBin the surface oyer structures placed <br />hereunder as may be necessary to insure the return of me roadway to a completely stable condition and until relieved of such responsibility <br />by the County Department of Public Works.Wherever a gravel,crushed rock or asphalt surface is removed or damaged hI.the course of <br />work rela:ted to the permitted encroachment,such ma1erial shall either be separately stored and replaced in the road~y as nearly as <br />possible in rIB Driginal stale or shall be replaced in kind,and the roadway shall be left in at least as good a cond1tion as it \vaS before the <br />~ommencement of operations of placing the encroachment structure_ <br />11."Whenever it becomes necessary to secure permission from abutting flied 'Withthe County Surveyo~_(Land Su...--veyors'Act Section 8771) <br />14.Prior to any excavation,the Permittee shall notify USA North (Underground Service Alert of Northern California and Nevada)at 811 or <br />800-227-2600 furty-eight (48)hours in advance.
