<br />3.All work shall be done subjectto the supervision of and the satisfaction oime grantor.ne Permittee shall at all times during the progress_
<br />of the work keep the County Highway in as neat and qlean condition as is possible and upon completion of me work authorized herein,

<br />4.The Permittee'also .agrees bytbe acceptance afthis permit to properly maintain any encroachment sb.llcture'P1aced by the Perm.ittee on lLTlY
<br />part of me County HizJry,'ay and to immediately repair any dmnage to any portion of me highway,which occurs as a result offue
<br />maintenance of the said encroachment strocture,until such time as thePermitiee may be relieved of the responsibility for silchmaintenancebytheCountyofSanJoaquin.
<br />5.The Permittee also agrees by the acceptance of ibis permit to make,.atits OWIl expense,such rep~as may-be deemed Ilecess8l}'by theCOUlltyDepartmentofPuhlicWorks.
<br />6.It is further agreed by the Permittee that whenever construction,reconstruCTionor maintenance work upon the highway is necessE!}',the
<br />installation provided for herein shall,upon request of the County Department of Public Works,be immediately moved or removed by and
<br />at the sol,e expense of the Permittee.
<br />7.No material used for fill or backfill in the constructioIl of the encroa.chmemshall be bOITO"wedor taken from 'wi'-Jlluthe County right of

<br />8..All work shall b~planned and carried aut with as little inC;Q~venieIlceas possible to the traveling public.No material shall be stacked

<br />the protection of the traveling public.Traffic con,trol standards shall be utilized including barricades;approved signs and lights;and
<br />flagmen,as required by the p8..t-ticularwork in progr.ess..
<br />9.The Permittee,by the acceptance of this permit,shall assume full responsibility for allliahility for personal injury or damage to property
<br />which may arise out of the work herein permitted or which may arise out of the failure of the part of the Permittee to properly peIform the
<br />work provided under this permit.In the event any claim of such liability is made against the County of San Joaquin or any department,
<br />official or employee thereof;the Permittee shall defen.d,indeninify,rmdhold each of them harmless fur such claim.
<br />10.All backfill ID8..t""erialisto be moistened as necessary and thoroughly compacted with mechanical means.Ifrequired by the County Director
<br />of Public Works,such backfill shall consist of gravel or crushed rock The Pei:mittee shall maintain the surface over structures placed
<br />hereunder as may be necessary to insure fuereturn,of the roadway to a completely stable condition and until relieved of such responsibility
<br />by the Co.unty Department of Public Works.'Wherever a gravel,crushed rock or asphalt surface is removed or damaged in the course of
<br />work related to the permitted eIlcroachment,such material shall either be separately stored and replaced in the ~oadW!iYas nearly as
<br />possible in its original state or shall be replaced in kind,and the roadway shall be left in at least as good a condItion as it was before the
<br />commencement of operations ofplacmg the encroachment structure..
<br />11.Whenever it becomes necessary to secure permission from abutting property ovmers for the proposed "\vorle,such aumority must be secured
<br />by me Permittee prior to sbirtiIJ.g,,'ork.
<br />12.The current and future safety and convenience of me traveling public shall be given every'considerationin the location and methods ofconstructionutilized.
<br />13.The Permittee is responsible for the preservation of survey monuments locared v.-i:tlrinthe area ofl"o'Drkherein permitled.Prior to the start
<br />of construction,survey monuments IDatpDterrtially may be disturbed shall be located and referenced by a Licensed Land Slll.-veyor,and a
<br />Comer Record filed 'Withthe County Sili--veyor.Any Survey Monuments disturbed during the course of OOnstruC-Q0TIshall be reesbblished
<br />by a Licensed.Laud SUITeyor and another Com:r Record filed mth the County Surveyo~.(Land SlL.--veyors'Act Section 8771)
<br />14.Prior tn ,allY excavation,the Pen:rritl:ee shall notifY USA North (Underground Service Alert of North em California and Nevada)at 811 or
<br />800-227-2600 forty-eight (48)hours in advance.
