ENCROACHMENT PERMIT GENERAL PROVISIONS

<br />Except as otherwise PTQ~dedfor public agencies and franchise holders,this permit is revocable on five days notice.
<br />3.All work shall be done subject to "thesupervision of and the satisfaction of the grantor.')1J.ePermi:ttee shall at all times during the progress-
<br />of the work keep the County ffighway in as neat and c:lean condition as is possible and upon completion ofihe work authorized herein,shall leave the Connty Highway in a thoroughly neat,clean and usable con~on.
<br />4.The Permittee'also ,agrees by the acceptance of this permit to properly maintain any encroacbmentstructnre-placed by the Permittee on any
<br />part of the County Higp,way and to immediately repair any damage to any portion of the highway.which occurs as a result of the
<br />maintenance of the said encroachment structure.until such time as mePerm1ttee may be relieved of me responsibility for such maintenancebythe,County of San Joaquin.,
<br />5.The Permittee also agrees by the acceptance of this permit to make,.at its oVrnexpense,such repairs as ma]'be deemed necessary by theCountyDeparbnentofPublicV/orks.
<br />6.It is further agreed by the Permittee that whenever construcpon,reconstruction.o!maintenance wad:upon the bighway is necessary,the
<br />installation provided for herein shall,upon request of me County Department of Public Works,be immediately moved ar removed by andatthesol,e expense of me Per:mittee.
<br />7.No material used for fill or backfill in the construction of the encroachment shall be borrowed or taken from \¥ithin the C011I1,tyright of
<br />V18,Y.
<br />Z.,All work shall be planned and carried out with as little inco~veillence as possible to the traveling public.No mai:~-ia1shall be stacked

<br />9.The Permittee,by the acceptance of this permit,shall assume full responsibility :for allliahility forpernon.aI injmy or damage to propertj
<br />which may arise out of the work herein permitted or which may arise out ofthe failure of the part ofllie Permittee to properly perform the
<br />work provided tmder this permit.In the event any claim of such liability is made against the County of San Joaquin or any department,
<br />official or employee thereot:the Permittee shall defend,indeuinify,and hold each ofthemhannless for such claim.
<br />'10.All backfill material is to be moistened as necessary and thoroughly compacted with mechaillccl means.Ifrequired by the COUIlfyDirector
<br />of Public Works,such backfill shall consist of gravel or crushed rock.The Peimittee shall maintain the surface over structures placed
<br />hereunder as IOay be necessary to insure the retlli-n of the roarlway to a completely stable condition 8llduntil relieved of such responsibility
<br />by the Co.unty Department of Public Works.V/herever a grave~crushed rock or asphalt surface is removed or damaged 1i1the course of
<br />work related to the permitted encroachment,such material shall either be separately stored and replaced in the roadw,ay as nearly as
<br />possible in its original sta:teor shall be replaced in kind,and the roadway shall be left in at least as good a condItion as it was before thecommencementofoperationsofplacingtheencroachmentstructure..
<br />11.Whenever it becomes necessary to secure per:mission from abutting property ovmers for the proposed 'Ivork,such authority must be securedbythePermitteepriortostartingwork.
<br />12.The current and future safety and convenience of the traveling public shall be given every 'consideration in the location and ~eth',]ds ofconstructionutilized.
<br />13.The'Permittee is responsible for the preservation of survey monuments locfu-"edViithin the lifea of work herem permitted.Prior to rue s'"t.art
<br />of construction,SllIYey monuments that potentially may be disturbed shall be located and referenced by a Licensed Land SllJ.--veyar,and a
<br />Comer Record :filed with the County Sn...-veyor.Any Survey Monuments disturbed during the course of construCTIon.shall be rees'"cililished
<br />by a Licensed.Laud Smveyor and another Comer Record filed with the County Surveyo~_(Land Slli-veyors'Act Secuon 8771)
<br />14.Prior to ,any excavation,the Permittee shall nomy USA North (UndergroUIld Service Alert of North em California and Nevada)at 811 or800-227-2600 forty-eight (48)hours in advance.
