<br />which may arise out of the work herein permitted or which may arise out of the failure oftbe part of me Permit'-tee to properly perrorm the <br />wm:k provided nnder this permit.In fue event any claim of such liability:is made a:ga.inst the County of San Joaquin OT any OeD'l...~eT't, <br />official or employee -mereor,the PeIID.1..'ti:eeshall defend"indeIJiuifj,and hold each ofihemharmless for such claim.. <br />.10.All back:fill IDfu"'erialis to be moistened as necess8J.--Yand thoroughly compacted wtill mechanical means.If reqUired by the C01mty Director <br />of Public Works,such baddill shall consist of gravel or crushed rock.The Permittee shall maintain the surface over structures placed <br />hereunder as may be necessary to insure the return oime roadway to a completely ,S"-iliblecondition and until relieved of such responsibility <br />by the County Department of Public Works.V!berever a gravel,crushed rock or asphalt surface is removed or damaged in the COllISeof <br />work related to the pennitted encroachment,such material shall either be separately stored and replaced in the roadw!'lY as nearly as <br />possible in its original state or shall be replaced in kind,aud the roadway shall be left in at least as good a cond1tion as it '\¥as before the <br />commencement ofopera:tions ofplacingfue encroachment structure. <br />11.Whenever it becomes necessary to secure permission from abutting property O'WDersfor the proposed ''lark,such authority must be secured <br />by the Permittee prior 1Dstarting work. <br />12.The cillTeut and future safety and convenience of the trave1iJJ.g public shall be giveD every.considerationin the location and ~ethods of <br />co:a.struction utilized.. <br />13.The Pennittee is responsible for the preservatiorr of mey monumerrLs locfu"'edwithin the area of work herein permitted..Prior to the S"l.3...rt <br />of construction,S1.1:rveymonuments that potentially may be disturbed shall be located and referenced by a Licensed Land S1.h--veyor,and a <br />Comer RecoTd :Bled vrr-ilithe COlmty Sili--veyor.Any SllTVey Monument;ci.ishrrbed dur:ing the course of construction shall be reestilllished <br />by a'Licensed lid Surveyor and another Comer Record filed with the Courrty SlJIVeyo~.(Land 8th-veyors'Act Section 8771) <br />14.Prior to .any excavation,the Permittee shall nofu-y USA North (UlldergrOlmd Service Alert of North em California and Nevada)at 811 or <br />800-227-2600 forty--eight (48)hours in advance.
