I was accompanied by Ms. Lori Oldfather. The field inspection
was conducted as a result of the construction of a pipeline by Mr. John Joseph DeMartini to convey all
storm water directly into the emban kment of the_Calaveras River. This work was all done without a
artment oFis
permit from the Depf h and Game for stye– am bei-alteration.
During the inspection I did not find any evidence that this facility had recently discharged any wastewater
either to land or to the Calaveras River. The Linden Nut Company is not subjected to a!12
permiLfrom-our office due to the type of operation, re-packing of nuts, therefore, I td not firm watern any
violations of State water quality laws during the time of inspection.
I do agree however, that the placement of the pipe into the embankment of the Calaveras River requires a
permit from Fish_andQame. Futhermore, the manner in which the construction was done, left large
amounts of uncompacted soil in the bank of the Calaveras River and during the winter months large
portions of this loose soil will be washed down into the Calaveras River. This situation will cause great
detriment to the fish and wildlife as well as the quality of the River.
I also found a pallet containing about 50+ qtd car batte ' This is an illegal storage of hazardous
materials and this will be referred to the San Joaquin County Environmental Health.
It is my understanding that the staff of the Department of Fish and Game will be following up on the
disturbance of the soil at the River embankment.
cc: ' State Department of Toxic Substance Control, Sacramento
San Joaquin County Environmental Health, Stockton
_(o "
i
I
