MAY-30-1996 13: 12 �3TOCKTON PERMIT CE14TER "9+937+66�8' <br /> SAN JOAQUIN COUNTY <br /> OFFICE OF EMERGENCY SERWCFS <br /> SAN JOAQUIN COUNTY HAZARDOUS MATERIALS • INFORMATION GUIDE <br /> The following are guidelines to identify businesses and to help building permit applicants determine whether they need to <br /> comply with the hazardous materials reporting requirements of Chapter 6.95 of the California Health and Safety Code with the <br /> Administering Agency. In San Joaquin County, the Office of Emergency Services (OES) has been appointed to be the Local <br /> Administering Agency. The program will provide County and other emergency response agencies with data needed for quick and <br /> safe response to hazardous material incidents and community right-to-know. <br /> This form becomes an official disclosure which will be ke�pt on file by OES for future reference. Should you have any <br /> questions,please call our office at(209)468-3969. <br /> "Hazardous Material" means any material that, beeaiuse of its quantity, concentration, or physical or chemical <br /> characteristics,poses a significant present or potential hazard to human health and safety or to the environment if released into <br /> the work place or the environment. (Includes fuels, petroleum products, paints, propane, oxygen, ammonia (ARM), chlorine <br /> (AHM),pesticides,fertilizers,and hazardous wastes...). <br /> GUIDELINES: <br /> Ouestions 1: <br /> If you answered "No",the business is exempted from completing the Hazardous Materials Management Plan (HMMP). If at a <br /> later date the applicant determines that their business or a tens' t will be handling hazardous materials, the applicant must inform <br /> OES within 30 days. <br /> Questions I and� <br /> If you answered"Yes",the business or future occupant must meet requirements of Chapter 6.95 Section 25505 of the California <br /> Health and Safety Code prior to issuance of a certificate of occupancy. Businesses which handle hazardous materials, at the <br /> California Threshold Planning Quantities,are required to file It FIMMP. Please contact our office for further information. <br /> If you answered"Yes" to Question 2 but your situation appli�s to one of the following exemption: please, mark the appropriate <br /> boxes on the survey form. <br /> A. RcLail Exemption - Products packaged for direct distribution to the general public are exempt from the program. <br /> However, written findings may be used to eliminate the exemption for the following reasons: 1) Quantity creates an <br /> unacceptable public hazard. 2) Product is being used directly by the business as part of its operations in addition to <br /> being sold to the general public, and 3) general public does not have ready access to the product as it is stored by the <br /> business, i.e., large quantities in a warehouse. <br /> B. bdf&ical Exemption - Medical offices which use gniy oxygen and/or nitrous oxide in quantities less than 1,100 cubic <br /> feet. <br /> C. Farm Exemption -Operation of a farm for the exclusive purpose of cultivating the soil. The definition of farm in the <br /> law is not be construed to include businesses providing commercial pest control services,fertilizer application services, <br /> product processing services,or packing shed services. Farms qualifying for the exemption are still required to submit <br /> an annual chemical inventory and fee to the County Agricultural Commissioner's Department. Please contact the <br /> County Agricultural Commissioner's Department fpr further information.Businesses operating a commercial business <br /> that meets the program requirements in addition to operating a "farm" as defined must comply with the HMMP <br /> program for those matenals associated with the commercial business. <br /> Questions 3 and 4: <br /> If you answered "Yes", the owner or future occupant handling an Acutely Hazardous Material must meet the requirements of <br /> Chapter 6.95, Sections 25533 and 25534 prior to the issuance of a certificate of occupancy. Businesses will be required to file <br /> an Acutely Hazardous Materials Registration Form and possibly complete a Risk Management and Prevention Program <br /> (RMPP). <br /> P�rtft <br />
