EARHART AVE., SUITE 300 <br />.7 STOCKTON, CALIFORNIA 95206 <br />/ TELEPHONE (209) 953-6200 <br />FAX (209) 953-6268 <br />08/11/2009 <br />NOTICE OF FAILURE TO COMPLY <br />WITH CHAPTER 6.95 OF THE HEALTH AND SAFETY CODE, <br />HAZARDOUS MATERIALS MANAGEMENT PLAN <br />Address: 4219 Morada Ln Stockton <br />Acct.: 13322 <br />An inspection to determine compliance with Chapter 6.95 of the Health and Safety Code was <br />conducted by a Hazardous Materials Specialist from the San Joaquin County Office of <br />Emergency Services. A copy of the Hazardous Materials Program Inspection Form, signed by a <br />representative of your business, indicating the existence of compliance issues was provided to <br />your business immediately after that inspection. If those compliance issues have not been <br />corrected by the due date listed on the bottom of the Hazardous Materials Program Inspection <br />Form, the compliance status of your business will be changed in our records to "Out of <br />Compliance with Notification". <br />If your business requires assistance in correcting identified compliance issues and attaining full <br />compliance with requirements of Chapter 6.95 of the Health and Safety Code, please contact the <br />Hazardous Materials Specialist who performed the inspection. A consultation appointment can <br />be arranged by calling the. Office of Emergency Services at (209) 953-6200. <br />If a business is determined to be "Out of Compliance with Notification", both the business and <br />business owner may be subject to legal action by the San Joaquin County District Attorney's <br />Office. If an action is brought, both the business and the business owner could face a court <br />ordered injunction and statutory penalties of up to $4,500 per day, or more in some cases. <br />In order to prevent your business from having a status of "Out of Compliance with <br />Notification," your business must make and submit corrections to documented deficiencies by <br />the deadline listed on the Hazardous Materials Program Inspection Form. Once corrections have <br />been confirmed, the Hazardous Materials Specialist will update your business status to "In <br />Compliance". <br />Please note that the general public, as well as regulatory and law enforcement agencies, <br />insurance carriers, or other businesses, are able to view a list of business sites with a current <br />status of "Out of Compliance with Notification" on the Office of Emergency Services Hazardous <br />Materials Management Plan Compliance Website. <br />A. <br />
