this Order at any time. This Order and any applicable program, <br /> plan, or schedule may be modified, terminated or revised by mutual <br /> written agreement of the parties at any time. Any modification to <br /> this Order shall be effective upon issuance and deemed <br /> incorporated in this Order. In addition, the Department reserves <br /> the right to take additional enforcement action including issuing <br /> new or additional Orders as provided by law. <br /> 4 . 19 Time Periods and Effective Date. Unless otherwise <br /> specified, time periods begin from the effective date of this <br /> Order, and "days" means calendar days. If any action is required <br /> to be done on a date which is a Saturday, Sunday or legal holiday, <br /> the time within which the action is to be taken shall be extended <br /> to the next business day following the Saturday, Sunday or legal <br /> holiday. The effective date of this Order is the date it is <br /> executed by the Department. <br /> 4 . 20 Noncompliance. Noncompliance by Respondents with <br /> this Order or any part thereof may subject Respondents to civil <br /> penalty provided by either HSC, Section 25189 or Section 25367. <br /> V. EXECUTION <br /> 5. This agreement may be executed in separate <br /> counterparts, each of which shall be deemed an original, but all <br /> of which together shall constitute one in the same document. <br /> 5. 1 Parties Bound. This Order will be binding upon and <br /> accrue to the benefit of the respective parties hereto and their <br /> successors and assigns. <br /> -16- <br />
