• 1 are pursuant to Health and Safety Code § 25516 hereby permanently enjoined from: 2 a. Violating Health and Safety Code §25503.5(a), being a business that handles a 3 hazardous material or a mixture containing a hazardous material that has a quantity at any one time during 4 the reporting year equal to, or greater than, a total weight of 500 pounds, or a total volume of 55 gallons, 5 or 200 cubic feet at standard temperature and pressure for compressed gas, including but not limited to 6 MOTOR OIL,ATF, GEAR OIL, ANTI-FREEZE, WASTE OIL, AND WASTE ANTIFREEZE, and 7 failing to establish and implement a business plan for emergency response to a release or threatened 8 release of a hazardous material; 9 b. Violating Health and Safety Code §25504(b), business plan fails to include emergency 10 response plans and procedures in the event of a reportable release or threatened release of a hazardous 1 I material, including but not limited to the following: 12 1. Immediate notification to the San Joaquin County Office of Emergency Services 13 and to the appropriate local emergency rescue personnel; 14 2. Procedures for the mitigation of a release or threatened release to minimize any 15 potential harm or damage to persons,property, or the environment; 16 3. Evacuation plans and procedures, including immediate notice, for the business 17 site; 18 c. Violating Health and Safety Code §25504(c), being a business that fails to train all new 19 employees and provide annual training, including refresher courses, for all employees in safety procedures 20 in the event of a release or threatened release of a hazardous material, including, but not limited to, 21 familiarity with the plans and procedures specified in Health and Safety Code §25504(b); 22 d. Violating Health and Safety Code §25505(a)(1),being a business that fails to submit a 23 business plan for emergency response to a release or threatened release of hazardous material in accordance 24 with the requirements of Health and Safety Code Chapter 6.95, Article 1; 25 e. Violating Health and Safety Code §25505(e)(2), being a business that fails to annually 26 submit a form,provided by the San Joaquin County Office of Emergency Services, that certifies that the 27 handler has included, and maintains as current,in the business plan, all other information required by 28 Health and Safety §25504. 2.
