TRACY, CA 95304 SUBJECT: NON-COMPLIANCE OF LESSEE: ARCH ARCO AM/PM 4855 S HWY 99 STOCKTON, CA 95215 Chapter 6.95, Division 20, Section 25500 et. seq. of the California State Health& Safety Code (commonly known as AB2185) requires businesses handling hazardous materials at or above the threshold limits to submit a Hazardous Material Management Plan(HMMP) and Chemical Inventory to the local Administering Agency. The Office of Emergency Services (OES) is the Administering Agency for San Joaquin County. Section 25503.6 of the California State Health& Safety Code requires lessees to provide a copy of their Hazardous Material Management Plan to property owners as follows: Any business which is required to establish and implement a business plan pursuant to Section 25503.5 and is located on leased or rented real property shall notify, in writing,the owner of the property that the business is subject to Section 25503.5 and has complied with its provisions, and shall provide a copy of the business plan to the owner or the owner's agent within five working days after receiving a request for a copy from the owner or the owner's agent. OES has attempted to collect a Hazardous Material Management Plan and Chemical Inventory from the business owner(s) Arch Arco Am/pm located at 4855 S Hwy 99 . Businesses which do not submit requested information in a timely manner are referred to the District Attorney's Office. Arch Arco Am/pm has not complied with the business plan requirements. Should there be a significant hazardous materials incident at this site, liability could be incurred by the property owner.
