1 violating §§ 25503.5 and 25505 of the California Health and Safety Code by failing to file timely <br /> 2 and comprehensive Hazardous Materials Management Plans with the County Office of <br /> 3 Emergency Services for the business located at 7735 S. HWY 99,WEST FRONTAGE ROAD, <br /> 4 STOCK TON, CALIFORNIA. If Defendant does not violate this injunction during the five-year <br /> 5 period, the injunction will automatically expire. However, if defendant does violate the <br /> 6 injunction during the five-year period, the injunction will automatically convert into a permanent <br /> 7 injunction. <br /> 8 5. Defendants shall pay to plaintiff the sum of TWELVE HUNDRED EIGHTY <br /> 9 DOLLARS.($1280.00) as and for civil penalties, pursuant to Health & Safety Code §§ 25514 and <br /> 10 25515.2. Said payment shall be due and payable to the following in accordance with Health and <br /> 11 Safety Code §§ 25514 and 25515.2; <br /> 12 Treasurer of San Joaquin County$540 <br /> 13 San Joaquin County Office of the District Attorney $270 <br /> 14 San Joaquin County Office of Emergency Services $270 <br /> 15 Hazardous Material and Waste Enforcement Training Fund $200 <br /> 16 Said payments shall be delivered to the Office of the San Joaquin County Office of the District <br /> 17 Attorney, Environmental Prosecutions Unit, prior to the filing of this Final Judgment. <br /> 18 6. Defendants shall pay to plaintiff the sum of TWO HUNDRED DOLLARS <br /> 19 ($200.00), for cost of investigation incurred by the San Joaquin County Office of Emergency <br /> 20 Services. Said payments shall be made payable to the SAN JOAQUIN COUNTY OFFICE OF <br /> 21 EMERGENCY SERVICES and delivered to the San Joaquin County Office of the District <br /> 22 Attorney, Environmental Prosecutions Unit,prior to the filing of this Final Judgment. <br /> 23 7. Defendants shall additionally pay to plaintiff the sum of FIVE HUNDRED <br /> 24 TWENTY DOLLARS ($520.00), for cost of investigation and suit incurred by the San Joaquin <br /> 25 County Office of the District Attorney.
