SAN <br /> J O A Q U I N Environmental Health Department <br /> —COUNTY <br /> Hazardous Materials Program Inspection Report <br /> Facility Name: Facility Address: Date: <br /> FIVE GUYS 5633 PACIFIC AVE, STOCKTON September 25, 2018 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 6 HSC 25505(a)(2) Failed to complete and/or submit a site map with all required content. <br /> A site map was not completed or submitted as part of the business plan. A site map shall contain a north <br /> orientation, loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, <br /> emergency shutoffs, evacuation staging areas, hazardous material handling and storage areas, and emergency <br /> response equipment. If a site map element is not applicable for your facility then list it on the map and label as <br /> "NA". Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> This is a minor violation. <br /> 8 CCR 2658, 2659 Failed to submit a training program or program is not reasonable or adequate for facility. <br /> A training program was lacking or insufficient. The training record is not available at the facility. Training programs <br /> for all employees and annual training, including refresher courses, shall include safety procedures for the event of a <br /> release or threatened release of a hazardous material, including, but not limited to,familiarity with the facility's <br /> emergency response plans and procedures. These training programs may take into consideration of each <br /> employee. Immediately prepare or update the facility's training program, log into the California Environmental <br /> Reporting System (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the <br /> EHD for approval. <br /> This is a Class II violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> No training records available. The business plan shall include provisions for ensuring that appropriate personnel <br /> receive initial and annual refresher training. This training shall be documented electronically or by hard copy and <br /> shall be made available for a minimum of three years. Immediately provide employee training for appropriate <br /> personnel and submit a copy of the training records to the EHD. <br /> This is a Class II violation. <br /> 12 HSC 25505(c)Failed to have the business plan readily available to facility or EHD personnel. <br /> Facility could not provide the Emergency Response Plan and the Chemical inventory upon request. The emergency <br /> response plans and procedures,the inventory of information required by this article, and the site map required by <br /> this section shall be readily available to personnel of the business or the unified program facility with responsibilities <br /> for emergency response or training pursuant to this section. Immediately make arrangements to have the business <br /> plan readily available for review. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by 10/25/18. <br /> Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152).
