The following is an itemized list of hazardous materials violations that have not been addressed for ARBYS #7447 as of February 05, 2018. Open violations from January 03, 2018 inspection Violation #6 - Failed to complete and/or submit a site map with all required content. A site map was not completed or submitted as part of the business plan. A site map shall contain a north orientation, loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, emergency shutoffs, evacuation staging areas, hazardous material handling and storage areas, and emergency response equipment. If a site map element is not applicable for your facility then list it on the map and label as "NA". Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. Provide on map all required information. At this time lack of loading area, adjacent streets, and emergency shut offs. Violation #7 - Failed to establish and/or submit emergency response procedures for a release or threatened release. The emergency response procedures were lacking or inadequate. A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to, the following: -immediate notification of local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment -evacuation plans and procedures, including immediate notice, for the site Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. Violation#8 -Failed to submit a training program or program is not reasonable or adequate for facility. A training program was lacking or insufficient. Training programs for all employees and annual training, including refresher courses, shall include safety procedures for the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the facility's emergency response plans and procedures. These training programs may take into consideration of each employee. Immediately prepare or update the facility's training program, log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. Violation#9 -Failed to annually review and certify that the business plan is complete,accurate, and up to date. The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually. The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. Last submittal was done 2014. Paper work on site dated 2010/2011. Print out report yearly. Violation#11 -Failed to provide or document initial and/or refresher training to appropriate personnel. All employees lack yearly training . The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years.
