The following is an itemized list of hazardous materials violations that have not been <br /> addressed for ARBYS #7447 as of February 05, 2018. <br /> Open violations from January 03, 2018 inspection <br /> Violation #6 - Failed to complete and/or submit a site map with all required content. <br /> A site map was not completed or submitted as part of the business plan. A site map shall contain a north <br /> orientation, loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, <br /> emergency shutoffs, evacuation staging areas, hazardous material handling and storage areas, and emergency <br /> response equipment. If a site map element is not applicable for your facility then list it on the map and label as <br /> "NA". Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> Provide on map all required information. At this time lack of loading area, adjacent streets, and emergency shut offs. <br /> Violation #7 - Failed to establish and/or submit emergency response procedures for a release or threatened <br /> release. <br /> The emergency response procedures were lacking or inadequate. A business plan shall include the following <br /> emergency response procedures for a release or threatened release of hazardous materials, including, but not <br /> limited to, the following: <br /> -immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> -evacuation plans and procedures, including immediate notice, for the site <br /> Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> Lack of nearest phone number for hospital, CUPA#209-468-3420, and regional water system#916-464-3291. <br /> Provide these phone#s on form. <br /> Violation#8 -Failed to submit a training program or program is not reasonable or adequate for facility. <br /> A training program was lacking or insufficient. Training programs for all employees and annual training, including <br /> refresher courses, shall include safety procedures for the event of a release or threatened release of a hazardous <br /> material, including, but not limited to, familiarity with the facility's emergency response plans and procedures. These <br /> training programs may take into consideration of each employee. Immediately prepare or update the facility's <br /> training program, log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> Violation#9 -Failed to annually review and certify that the business plan is complete,accurate, and up to <br /> date. <br /> The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br /> System (CERS) annually. The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year. Immediately log into the CERS at <br /> http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br /> Last submittal was done 2014. Paper work on site dated 2010/2011. Print out report yearly. <br /> Violation#11 -Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> All employees lack yearly training . The business plan shall include provisions for ensuring that appropriate <br /> personnel receive initial and annual refresher training. This training shall be documented electronically or by hard <br /> copy and shall be made available for a minimum of three years. Immediately provide employee training for <br /> appropriate personnel and submit a copy of the training records to the EHD. <br /> Page 1 of 1 <br />
