The following is an itemized list of hazardous materials violations that have not been <br /> addressed for Pinnacle Ag as of November28, 2018. <br /> Open violations from September 26, 2018 inspection <br /> Violation #2 - Failed to complete and electronically submit a hazardous materials business plan. <br /> The facility's business plan was not submitted electronically to the California Environmental Reporting System <br /> (CERS). As of January 1, 2013, all businesses were required to submit all business plans electronically. <br /> Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to <br /> the EHD for approval. <br /> Violation#3 - Failed to establish and implement a hazardous materials business plan. <br /> A Hazardous Materials Business Plan has not been established or implemented. A Hazardous Materials Business <br /> Plan shall be established and implemented for emergency response to a release or threatened release of a <br /> hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for <br /> materials that are liquids, 500 pounds for solids, or 200 cubic feet for compressed gas, at standard temperature and <br /> pressure. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br /> enter the required information, and submit for review by the EHD. <br /> Violation #4 - Failed to complete and/or submit the Business Activities or Owner/Operator Identification <br /> page. <br /> The Business Activities and Owner/Operator Identification forms have not been submitted. This information must <br /> be current and submitted as part of the business plan. Immediately log into the California Environmental Reporting <br /> System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for <br /> approval. <br /> Violation #5 - Failed to complete and/or submit hazardous materials inventory for all reportable materials on <br /> site. <br /> Eleven 55 gallon drums of grease, one 55 gallon drum of Coil Guard, six 55 gallon drums of antifreeze, one 55 <br /> gallon drum of Hyperion 6000, five 55 gallon drums of oil, two 55 gallon drums of waste oil, eight 8 gallon propane <br /> cylinders, Two cylinders of compressed oxygen(278 c.f. and 125 c.f.), two cylinders of acetylene (111 c.f. and 100 <br /> c.f.), and two 55 gallon drums of diesel exhaust fluid were found on site that have not been reported. Any material <br /> that meets or exceeds the reportable quantity shall be reported in the facility's business plan. Immediately log into <br /> the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the <br /> hazardous material inventory, and submit to the EHD for approval. <br /> Violation #6 - Failed to complete and/or submit a site map with all required content. <br /> A site map was not completed or submitted as part of the business plan. A site map shall contain a north <br /> orientation, loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, <br /> emergency shutoffs, evacuation staging areas, hazardous material handling and storage areas, and emergency <br /> response equipment. If a site map element is not applicable for your facility then list it on the map and label as <br /> "NA". Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> Violation #8 - Failed to submit a training program or program is not reasonable or adequate for facility. <br /> A training program was not submitted. Training programs for all employees and annual training, including refresher <br /> courses, shall include safety procedures for the event of a release or threatened release of a hazardous material, <br /> including, but not limited to, familiarity with the facility's emergency response plans and procedures. These training <br /> programs may take into consideration of each employee. Immediately prepare or update the facility's training <br /> program, log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> Violation #12 - Failed to have the business plan readily available to facility or EHD personnel. <br /> Facility could not provide the Emergency Response Plan and the Chemical inventory upon request. The emergency <br /> response plans and procedures, the inventory of information required by this article, and the site map required by <br /> this section shall be readily available to personnel of the business or the unified program facility with responsibilities <br /> for emergency response or training pursuant to this section. Immediately make arrangements to have the business <br /> plan readily available for review. <br /> Page 1 of 1 <br />
