9. As used in this Deposition Subpoena for Production of Business Records, the <br /> term "BUSINESS PLAN" shall have the definition provided at California Health and <br /> Safety Code Section 25501 (e). Health and Safety Code Section 25501(e) provides: <br /> "Business plan" means a separate plan for each facility, site, or branch of a business that <br /> meets the requirements of Section 25504 (a)—(c). <br /> 10. As used in this Deposition Subpoena for Production of Business Records, the <br /> term "HAZARDOUS MATERIAL" and "HAZARDOUS MATERIALS" shall have <br /> the definitions provided at Health & Safety Code section 25501(o). Health & Safety <br /> Code Section 25501(o) provides: "Hazardous material' means any material that, because <br /> of its quantity, concentration, or physical or chemical characteristics, poses a significant <br /> present or potential hazard to human health and safety or to the environment if released <br /> into the workplace or the environment. "Hazardous materials" include, but are not <br /> limited to, hazardous substances, hazardous waste, and any material that a handler or the <br /> administering agency has a reasonable basis for believing would be injurious to the health <br /> and safety of persons or harmful to the environment if released into the workplace or the <br /> environment. <br /> 11. As used in the Deposition Subpoena for Production of Business Records, the term <br /> "COMMUNICATIONS" means every disclosure, transfer, exchange or transmission of <br /> information, whether oral or written, and whether face to face or by telecommunications, <br /> computer, mail, facsimile, or otherwise between YOU and/or from YOU to UHC, UHI, <br /> ARE, AMERCO, and/or UHRE. <br /> DOCUMENTS TO BE PRODUCED <br /> For each of the FACILITIES set forth [herein] or [in Exhibit A hereto] provide <br /> the following DOCUMENTS received by you during, or applicable to, the period of <br /> January 1, 2000 to the present: <br /> 1. All BUSINESS PLANS for each of the FACILITIES. <br /> 2. All corrected, revised, amended and/or modified BUSINESS PLANS for each of <br /> the FACILITIES. <br /> 3. All certifications pursuant to Health & Safety Code section 25503.3 (c) and <br /> California Code of Regulations, Title 19, section 2729.5 for each of the FACILITIES, <br /> including all corrected, revised, amended and/ or modified certifications for each of the <br /> FACILITIES pursuant to this statute and regulation. <br /> 4. All Business Owner/Operator Identification Page(s) and Hazardous Materials- <br /> Chemical Description Page(s) pursuant to California Code of Regulations, Title 19, <br /> section 2729.5, for each of the FACILITIES, including all corrected, revised, amended <br /> and/ or modified Business Owner/Operator Identification Page(s) and Hazardous <br /> Materials-Chemical Description Page(s) for each of the FACILITIES pursuant to this <br /> regulation. <br /> Page 2 of 4 <br />
