Environmental Health Department Hazardous Materials Program Inspection Report Date: July 24, 2018 Facility Address: 824 E YOSEMITE AVE, MANTECA Facility Name: DIAMOND GAS AND FOOD MART SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) RemarksItem # 6 HSC 25505(a)(2) Failed to complete and/or submit a site map with all required content. The site map was not complete as part of the business plan. The site map is missing the storm drain locations, adjacent streets, evacuation staging area, emergency shut off locations for the fuel, a north orientation, emergency response equipment locations, and hazmat storage areas. A site map shall contain a north orientation, loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, emergency shutoffs, evacuation staging areas, hazardous material handling and storage areas, and emergency response equipment. If a site map element is not applicable for your facility then list it on the map and label as “NA". Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This is a minor violation. 7 HSC 25505(a)(3) Failed to establish and/or submit emergency response procedures for a release or threatened release. The emergency response procedures were not complete. The emergency response procedures are missing the local Unified Program Agency (UPA) phone number witch is 209-468-3420. Please fill out all sections in the emergency response and contingency plan. A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment - evacuation plans and procedures, including immediate notice, for the site Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 9 HSC 25508(a)(1) Failed to annually review and certify that the business plan is complete, accurate, and up to date. The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually. The business plan was last submitted 7/10/2017. Please make a submittal for 2018. The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 8/23/2018 . Please be aware as of January 1, 2013, all businesses are required to submit all hazardous materials information online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov.
