EARHART AVE., SUITE 300 STOCKTON, CALIFORNIA 95206 TELEPHONE (209) 953-6200 FAX (209) 953-6268 04/13/2009 NOTICE OF FAILURE TO COMPLY WITH CHAPTER 6.95 OF THE HEALTH AND SAFETY CODE, HAZARDOUS MATERIALS MANAGEMENT PLAN Address: 3748 Zephyr Ct Stockton Acct.: 14010 An inspection to determine compliance with Chapter 6.95 of the Health and Safety Code was conducted by a Hazardous Materials Specialist from the San Joaquin County Office of Emergency Services. A copy of the Hazardous Materials Program Inspection Form, signed by a representative of your business, indicating the existence of compliance issues was provided to your business immediately after that inspection. If those compliance issues have not been corrected by the due date listed on the bottom of the Hazardous Materials Program Inspection Form, the compliance status of your business will be changed in our records to "Out of Compliance with Notification". If your business requires assistance in correcting identified compliance issues and dttaining t the full compliance with requirements of Chapter 6.95 of the Health and Safety Code, please Hazardous Materials Specialist who performed the inspection. A consultation appointment can be arranged by calling the Office of Emergency Services at (209) 953-6200. If a business is determined to be "Out of Compliance with Notification", both the business and business owner may be subject to legal action by the San Joaquin County District Attorney's Office. If an action is brought, both the business and the business owner could face a court ordered injunction and statutory penalties of up to $4,500 per day, or more in some cases. In order to prevent your business from having a status of "Out of Compliance with Notification," your business must make and submit corrections to documented deficiencies by the deadline listed on the Hazardous Materials Program Inspection Form. Once corrections have been confirmed, the Hazardous Materials Specialist will update your business status to "In Compliance". Please note that the general public, as well as regulatory and law enforcement agencies, insurance carriers, or other businesses, are able to view a list of business sites with a current status of "Out of Compliance with Notification" on the Office of Emergency Services Hazardous Materials Management Plan Compliance Website.
