The Professional Engineer(PE)certification is incomplete.The page for the PE certification did not have a PE signature or seal,for the copy of the SPCC plan found at the"aggregate"facility, dated May 2017.The copy of the SPCC plan found at the"ready mix"facility had a PE certification but was last reviewed in 2013. Both plans included tanks for both facilities.The PE certification must include all of the aspects in 40 CFR 112.3(d)(1), including attesting that the PE is familiar with 40 CFR Part 112, he or his agent has visited and examined the facility, the Spill Prevention, Control, and Countermeasure(SPCC) Plan has been prepared in accordance with good engineering practice, including consideration of applicable industry standards, procedures have been established for required inspections and testing, and the Plan is adequate for the facility. Immediately obtain a complete PE certification for the facility's SPCC Plan. Submit a copy of the completed certification to the EHD. This is a Class II violation. 203 CFR 112.3 Failure to implement the SPCC Plan. The SPCC plan states that"Appendix E"will contain a list of environmental emergency coordinators and their phone numbers. No such list was observed in "Appendix E"of the plan. The SPCC plan states that a warning sign would be placed at fueling areas, reminding drivers not to depart until all hoses are disconnected and fuel pump is turned off.A sign similar to the one described in the SPCC plan was not observed at the fueling areas of the facility. The owner or operator of an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan"or"Plan")," in accordance with § 112.7 and any other applicable section of this part. Implement the SPCC plan as written or amend to plan to reflect current practices and procedures. This is a minor violation. 601 CFR 112.7 Failure of Plan to fulfill basic requirements including a cross-referencing section. The page in the SPCC plan addressing the full approval of management was not signed or dated. If you are the owner or operator of a facility subject to this part you must prepare a Plan in accordance with good engineering practices.The Plan must have the full approval of management at a level of authority to commit the necessary resources to fully implement the Plan.You must prepare the Plan in writing. If you do not follow the sequence specified in this section for the Plan, you must prepare an equivalent Plan acceptable to the Regional Administrator that meets all of the applicable requirements listed in this part, and you must supplement it with a section cross-referencing the location of requirements listed in this part and the equivalent requirements in the other prevention plan. If the Plan calls for additional facilities or procedures, methods, or equipment not yet fully operational, you must discuss these items in separate paragraphs, and must explain separately the details of installation and operational start-up.
