The <br /> reviewed Spill Prevention, Control, and Countermeasure (SPCC) Plan is not being implemented as written. The <br /> reviewed SPCC plan states that storm water accumulations with oily content will be handled as hazardous waste, <br /> according to the onsite inspection the oily "rinse water" is being given to farmers for reuse. All facilities which have an <br /> APSA regulated shell capacity of 1,320 gallons or greater shall prepare and implement a written SPCC Plan which <br /> meets all of the requirements of the 40 CFR Part 112. This plan shall be certified by a professional engineer in <br /> accordance with 40 CFR 112.3(d). Immediately prepare and implement an SPCC Plan in accordance with 40 CFR <br /> Part 112, which that includes all aboveground petroleum storage containers 55 gallons or larger. Submit proof of <br /> correction to the END. <br /> This is a Class II violation. <br /> 601 CFR 112.7 Plan that does not follow the sequence specified in this section lacks a cross-referencing section. <br /> The Spill Prevention, Control, and Countermeasure (SPCC) Plan does not follow the order or requirements in 40 CFR <br /> Part 112, and a cross-reference was not provided. If you do not follow the sequence specified in 40 CFR 112 for the <br /> Plan, you must prepare an equivalent Plan and supplement it with a section cross-referencing the location of <br /> requirements in 40 CFR 112 and the equivalent Plan. Immediately amend the SPCC Plan to include a cross-reference <br /> or to follow the required sequence. <br /> This is a minor violation. <br /> Page 3 of 6 <br />
