The Department of Toxic Substances Control (DTSC) has reviewed <br /> and approved this company's application to be a Certified Appliance Recycler (CAR). <br /> After reviewing and approving a CAR application for conformance with section 25211.4 <br /> of the Health and Safety Code, DTSC is required to transmit all application documents <br /> to the Certified Unified Program Agency (CUPA) in whose jurisdiction the business or <br /> person is located. <br /> The CUPA is required to inspect the CAR facility "as soon as is practicable" to <br /> determine whether the recycler is capable of properly removing and managing all <br /> Materials that Requires Special Handling (MRSH) from major appliances (Health & Saf. <br /> Code § 25211.4(d)). The statute requires CUPAs to consider the working condition of <br /> the equipment, the technical ability of the employees, the facility's compliance with <br /> existing law (Health & Saf. Code § 25211 et seq., and Pub. Resources Code § 42160 <br /> et seq.). <br /> Please refer to the DTSC Fact Sheet entitled "AB 1447 (2007) Changes to the <br /> Appliance Recycling Program" (available on our CAR Web page) for a summary of the <br /> existing law. In summary, an appliance recycler must be certified by DTSC prior to <br /> removing MRSH and discarding major appliances. MRSH may not be disposed of in <br /> the garbage or at a solid waste facility. <br /> The law also prohibits anyone from transporting, delivering, or selling discarded major <br /> appliances to a scrap recycling facility unless one of three conditions are met: <br /> 1. the appliances have not been processed in a manner that could release, <br /> or prevent the removal of MRSH, and the receiving scrap metal facility <br /> has been certified by DTSC to remove the remaining MRSH; or <br /> ® Printed on Recycled Paper <br />
