Department of Toxic Substances Control <br />700 Heinz Avenue <br />Berkeley, California 94710-2721 <br />SUMMARY OF i <br />Facility Name: ECS Refining in Stockton Date: May 7 and 8. 2012 <br />Continuation Sheet for SECTION I: NON - MINOR VIOLATIONS <br />AND REQUIRED CORRECTIVE ACTION <br />remains closed. Within twenty-one (21) calendar days of the date of this SOV, ECS Refining <br />shall submit photographs showing examples of the lamps in a closed box. <br />3. ECS Refining violated Cal. Code Regs., title 22, section 66273.38(x), in that between <br />December 27, 2011 and January 26, 2012, ECS Refining sent universal waste to a place <br />other than another universal waste handler, a destination facility or a foreign destination. <br />Between December 27, 2011 and January 26, ECS Refining sent universal waste to <br />Regenesys at the 1111 Runway Drive location in Stockton. The Regenesys Runway Drive <br />location was not an authorized universal waste handler or a destination at that time. <br />Corrective Action: The compliance of the violation will be verified in future inspections. <br />4. ECS violated Cal. Code Regs., title 22, sections 66262:34(f) (1) and (3) in that on or about <br />and prior to May 8, 2012, ECS Refining failed to label or mark one 55 -gallons drum <br />containing baghouse dust the initial accumulation date, the words "Hazardous Waste", the <br />composition and physical state of the waste, the statement about the particular hazardous <br />properties of the waste, and name and address of the person producing the waste. <br />One 55 -gallon drum containing bag- house waste generated from the main shredder was not <br />labeled. The drum was labeled during the inspection. <br />Corrective Action: No further action is required. <br />5. ECS violated Cal. Code Regs., title 22, sections 66262.34(a) (1)(A) and 66265.173(a) in <br />that on or about and prior to May 8, 2012, ECS Refining failed to close a container holding <br />hazardous waste during transfer and storage, except when it is necessary to add or remove <br />waste. <br />One 55 -gallon drum containing bag- house waste generated from the main shredder was not <br />closed. The violation was corrected during the inspection. <br />Corrective Action: No further action is required. <br />6. ECS violated Cal.
