Department of Toxic Substances Control <br />700 Heinz Avenue <br />Berkeley, California 94710-2721 <br />SUMMARY OF VIOLATIONS <br />Facility Name: _.Be <br />genesys Glass Processing(RGP) Dats; May 7 and 8, 2012 <br />Continuation Sheet for SECTION I: NON - MINOR VIOLATIONS <br />AND REQUIRED CORRECTIVE ACTION <br />increase in capacity of greater than 10%. <br />During the May 8, 2012 inspection, RGP provided DTSC the inventory records for RGP. <br />These records include combined inventory records for both the RGP Sinclair and Runway <br />facilities and inventory records for the RGP Runway location only. On May 10, 2012, RGP <br />submitted all inventory records for the Sinclair location. These records show that the amount <br />of universal waste stored at the RGP Sinclair location was 1,668,711 pounds, while the <br />closure plan indicates that the maximum inventory of universal waste is 687,500 pounds. <br />The increase in inventory is about 140 %. <br />Corrective Action: RGP is required to modify the closure plan whenever there is a change <br />in facility capacity of greater than 10%. Within thirty (30) calendar days of the date of this <br />SOV, RGP shall submit to DTSC for its review a revised closure plan to reflect the current in <br />facility storage capacity/inventory. <br />4. RGP violated Cal. Code Regs., title 22, sections 66273.72 (c) (2)(C)7, in that on or about <br />and prior to May 8, 2012 RGP failed to ensure that aisle spacing was maintained in <br />compliance with applicable fire safety code standards in California. <br />Approximately ten rows containing boxes of CRT glass did not have aisle space between <br />them. <br />Corrective Action: Within twenty one (21) calendar days of the date of this SOV, RGP must <br />create aisle spacing in compliance with applicable fire safety code standards, submit a <br />description of what the standards are, and submit legible photographs showing compliance <br />with the standards. <br />DTSC (NOVEMBER 2007) Page_ of <br />
