SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR -Notice to Comply) UST Inspection: Routine & Annual Monitoring System Certification. Class II/ Repeat Violation: 104, 206 104. Financial responsibility documents have not been submitted to the EHD for 2012 year. No documents received for 2011 year either. Current financial responsibility documents are required to be submitted annually. Complete and submit a copy of the Certification of Financial Responsibility along with the insurance policy or a Letter from Chief Financial Officer. 206. The Designated Operator (DO) employee training for all employees responsible for the diesel tank were not current. Last training by the designated operator occurred on September 29, 2011. No current records can be located. The DO shall train facility employees for which he or she is responsible in the proper operation and maintenance of the UST system once every 12 months. The training shall include, but is not limited to: 1. Operation of the UST system in a manner consistent with the facility's best management practices 2. Employee's role with regard to monitoring equipment as specified in the facility's monitoring plan 3. Employee's role with regard to spills and overfills as specified in the facility's response plan 4. Name of the contact person(s) for emergencies and monitoring equipment alarms Ensure that employees have been trained by the DO, maintain the list on site, and submit a copy of the training records to the EHD. Submit to SJC EHD within 30 days (11/02/12): 1. one copy of the completed "Return to Compliance Certification" form 2. a written corrective action statement how each of the above violations would be corrected along with how to ensure violation would not be repeated 3. requested / supporting documentation ie. financial responsibility & employee training roster Notes: - On site with Facility Mgr explained UST system (set up & sensors), testing requirements & dates, documentation (DO monthly reports & alarm records & maintenance/ repairs), employee training. Explained Hazardous waste: storage period time, labeling, types of waste generated, training records, disposal records, emergency action plan/ contingency plan, free training Explained Universal waste: storage period time, labeling, types of waste generated -Next secondary containment testing due by 09/2013. Submit 48 hr advance notification of test -Last MC,S13 testing performed 09/16/11. Was due by 09/2012 but reschedule b/c Inspector unavailable -Provided free training schedule. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
