SANJ O 1` Q U I `IA,II, Environmental Health Department <br /> COUNTY <br /> Aboveground Petroleum Storage Act Inspection Report <br /> Facility Name: Facility Address: Date: <br /> GARDNER TRUCKING INC 2577 W YOSEMITE AVE, MANTECA December 18, 2018 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 613 CFR 112.7(c) Failure to provide appropriate secondary containment, diversionary structures or equipment. <br /> The tank described in the SPCC plan as a single walled 240 gallon motor oil tank is described in the Plan as being <br /> provided with secondary containment by the shop concrete floor.The Plan describes the floor as sloping towards <br /> the center of the building.The Plan does not address a trench in the center of the building that was described by <br /> facility personnel as terminating at an oil/water separator. A facility shall provide appropriate containment and/or <br /> diversionary structures or equipment to prevent a discharge. The entire containment system, including walls and <br /> floor, must be capable of containing oil and must be constructed so that any discharge from a primary containment <br /> system will not escape the containment system before cleanup occurs. Immediately provide adequate secondary <br /> containment for all aboveground petroleum storage containers larger than 55 gallons. <br /> This is a minor violation. <br /> 618 CFR 112.7(e), 112.8(c)(6) Failed to keep records of procedures, inspections,or integrity tests for three years. <br /> Copies of inspection and testing records for were not found on site. The SPCC plan calls for monthly and annual <br /> documented inspections by the facility. Inspections and tests must be conducted in accordance with the written <br /> procedures developed in the Spill Prevention, Control, and Countermeasure(SPCC)Plan. Records of these <br /> inspections and tests must be signed by the appropriate supervisor or inspector and kept on site with the SPCC <br /> Plan for a period of three years. Immediately locate a copy of all inspection and testing records for the last three <br /> years, maintain them on site, and submit copies to the EHD or start implementing the plan as written and follow <br /> testing and inspection procedures as outlined in the SPCC plan. <br /> This is a Class II violation. <br /> 619 CFR 112.7(f)(1) Failed to train personnel on all discharge prevention details listed in this section. <br /> Oil handling personnel were not trained. At a minimum, oil handling personnel shall be trained in the operation and <br /> maintenance of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, <br /> rules, and regulations; general facility operations; and the contents of the Spill Prevention, Control, and <br /> Countermeasure Plan. Immediately provide this training to all oil handling personnel and submit a copy of the <br /> training log to the EHD. <br /> This is a Class II violation. <br /> 621 CFR 112.7(f)(1) Failure to include in the SPCC Plan an adequate description of employee training. <br /> Discharge prevention briefings are not scheduled at least once a year. Discharge prevention briefings for oil <br /> handling personnel must be scheduled and conducted at least once a year to assure adequate understanding of the <br /> SPCC Plan for that facility. Such briefings must highlight and describe known discharges or failures, malfunctioning <br /> components, and any recently developed precautionary measures.
