EI Dorado Street <br /> Stockton, CA <br /> The San Joaquin County Environmental Health Department (EHD) has overseen the <br /> assessment and cleanup activities at the above subject site since May 1998. A 250 gallon <br /> underground storage tank (UST) for waste oil was removed from the site on March 26, 1997. <br /> There were high concentrations of total petroleum hydrocarbons as diesel and motor oil and low <br /> concentrations of Tetrachloroethene in the soil sample collected beneath the UST at the time of <br /> removal. In June 2001 free product motor oil was discovered in the monitoring well placed in <br /> the former UST location. Free product removal was discontinued in April 2006 since there were <br /> no longer observations of free product. <br /> The State Water Resouces Control Board Cleanup Fund was reimbursing the responsible party <br /> (RP) for corrective action costs initially but in May 2006 informed the RP that no additional costs <br /> would be reimbursed because the investigation was for solvents not petroleum. The attorney <br /> for the RP has appealed that decision but to date the decision has not been reversed. <br /> The EHD and Central Valley Regional Water Quality Control Board staff met with the RP's <br /> representatives, attorney and consultant on June 6, 2006 and March 20, 2008 to discuss the <br /> further investigation that was required. The last quarterly monitoring and sampling of the site <br /> monitoring wells was on June 20, 2006. Work plans that were submitted in February 2005 and <br /> March 2008 and were approved by the EHD have not been implemented. In a telephone <br /> conversation with the RP's consultant on May 12, 2008, the EHD was informed that there has <br /> been no instruction from the RP representatives to implement the current work plan or resume <br /> quarterly monitoring. Enclosed is a chronology showing the responsible party's history of <br /> recalcitrance in responding to regulatory directives and performing work at the site. <br />
