The petition was filed on behalf of Gene Gabbard, Inc. and is complete pursuant to the requirements of the California Code of Regulations, title 23, section 2814 at seq. In the petition, you requested a hearing to present this matter to the Division Chief. Since the Division Chief issued her Final Division Decision (FDD) regarding these issues on October 3, 2006, 1 am assuming that you intended to request a hearing before the State Water Resources Control Board (State Water Board or Board) as it is the State Water Board that will be reviewing the Division Chiefs decision. After considering all of the material submitted with the petition in accordance with the relevant regulations and all the documents in the claimant's Underground Storage Tank Cleanup Fund file, the State Water Board will decide if it is appropriate to hold a hearing on this matter. Since the Board may ultimately decide not to hold a hearing, it is important for you to provide, in writing, all arguments that the petitioner would like the Board to consider. Please submit any additional reasons that you believe the FDD was improper and any other relevant arguments within 30 days of the date of this letter. The submittal should be sent to Ms. Tam Doduc, Chair of the State Water Board, with copies to Mr. Michael A.M. Lauffer, Chief Counsel, and Ms. Barbara L. Evoy, Deputy Director of the Division of Financial Assistance at the following address: State Water Resources Control Board P.O.
