The petition was <br /> filed on behalf of Gene Gabbard, Inc. and is complete pursuant to the requirements of the <br /> California Code of Regulations, title 23, section 2814 at seq. <br /> In the petition, you requested a hearing to present this matter to the Division Chief. Since the <br /> Division Chief issued her Final Division Decision (FDD) regarding these issues on October 3, <br /> 2006, 1 am assuming that you intended to request a hearing before the State Water Resources <br /> Control Board (State Water Board or Board) as it is the State Water Board that will be reviewing <br /> the Division Chiefs decision. <br /> After considering all of the material submitted with the petition in accordance with the relevant <br /> regulations and all the documents in the claimant's Underground Storage Tank Cleanup Fund <br /> file, the State Water Board will decide if it is appropriate to hold a hearing on this matter. Since <br /> the Board may ultimately decide not to hold a hearing, it is important for you to provide, in <br /> writing, all arguments that the petitioner would like the Board to consider. Please submit any <br /> additional reasons that you believe the FDD was improper and any other relevant arguments <br /> within 30 days of the date of this letter. The submittal should be sent to Ms. Tam Doduc, Chair <br /> of the State Water Board, with copies to Mr. Michael A.M. Lauffer, Chief Counsel, and <br /> Ms. Barbara L.
