SAN JOAQUIN COUNTY <br /> ENVIRONMENTAL HEALTH DEPARTMENT <br /> 1868 East Hazelton Avenue, Stockton, California 95205-6232 <br /> Telephone: (209)468-3420 Fax: (209)468-3433 Web:www.sigov.org/ehd <br /> CONTINUATION FORM Page: 4 of 5 <br /> OFFICIAL INSPECTION REPORT Date: 04/10/13 <br /> Facility Address: 7600 Windmill Cove Rd., Stockton Program: APSA <br /> SUMMARY OF VIOLATIONS <br /> CLASS I, CLASS II, or MINOR-Notice to Comply) <br /> Class 11 violations: (101, 401, 514, 517, 603, 607, 609, 611) <br /> 101 & 401. Facility has an APSA regulated shell capacity of 2,500 gallons. No Spill Prevention & <br /> Countermeasure Control (SPCC) Plan was available on site. All facilities which have an APSA <br /> regulated shell capacity of 1,320 gallons or greater shall prepare a written SPCC Plan which meets all of <br /> the requirements of the Code of Federal Regulations Title 40, Part 112 (40 CFR 112). This facility <br /> qualifies as a Tier I facility, which has no aboveground oil storage containers with a capacity greater than <br /> 5,000 gallons. Immediately prepare a SPCC Plan in accordance with 40 CFR 112, which will include all <br /> aboveground petroleum storage containers 55 gallons or larger. A template for Tier I SPCC Plans has <br /> been provided. Submit a copy of the properly Professional Engineer (PE) or self-certified SPCC Plan to <br /> the EHD for review by May 12, 2013. A copy shall be maintained on site at all times. <br /> 514 & 607. The single-walled gasoline tank on site does not have secondary containment. A facility <br /> shall provide appropriate containment and/or diversionary structures or equipment to prevent a <br /> discharge. The entire containment system, including walls and floor, must be capable of containing oil <br /> and must be constructed so that any discharge from a primary containment system will not escape the <br /> containment system before cleanup occurs. All bulk storage tanks must be provided with a secondary <br /> means of containment for the entire capacity of the tank and sufficient freeboard to contain precipitation. <br /> Immediately provide adequate secondary containment for all aboveground petroleum storage containers <br /> 55 gallons and larger. <br /> 517. The inspection forms being used are not part of a SPCC Plan, and do not include the signature of <br /> an inspector or supervisor. Inspections and tests must be conducted in accordance with the written <br /> procedures developed in the SPCC Plan. Records of these inspections and tests must be signed by the <br /> appropriate supervisor or inspector and kept on site with the SPCC Plan for a period of three years. <br /> Immediately begin conducting all inspections and tests in accordance with the procedures in a certified <br /> SPCC Plan. <br /> 603. The gasoline tank is located in such a way that drainage from the tank would flow directly into the <br /> waterways. Facility drainage systems from undiked areas with a potential for a discharge (such as <br /> where piping is located outside containment walls or where tank truck discharges may occur outside the <br /> loading area) must be designed to flow into ponds, lagoons, or catchment basins designed to retain oil <br /> or return it to the facility. You must not locate catchment basins in areas subject to periodic flooding. <br /> Immediately provide proper, adequate drainage systems for all undiked areas with a potential for <br /> discharge. <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD Inspector: Received By: Title: <br /> Stacy Rivera (209) 468-3440 <br /> EHD 23-02-003 Rev 04/19/12 CONTINUATION FORM <br />
