Aris Cacapit [EH]
From: Thomas Lyon [oilstop1 @gmail.com]
Sent: Sunday, November 20, 2011 3:25 PM
To: Aris Cacapit [EH]
Subject: Response to October 19, 2011 Inspection
Aris -
In response to your field inspection and list of violations, this memo will serve as my statement of how
each violation was corrected. I have also completed a Return to Compliance Cetification. All of these
documents were sent out to you via the USPS as the amount of paperwork required to meet my
obligation was too much to fax. I have taken the following actions:
1. 601. There are seven (7) UST that you require be elevated to allow for complete visual inspection. I
have been in touch with the tank manufacturer and they have causioned me that attempting to move
these tanks while they are full of product could possibly cause damage to them, including causing leaks.
I propose that we be allowed to drain these tanks and move them while they are empty. This will allow
me to avoid any risk of damage to the tanks. I anticipate this will take up to 90 days to complete,
depending on how quickly we can drain each tank. We will begin this process immediately and have it
completed by January 30, 2012, for all 7 tanks. At that time all 7 tanks will be in a position to allow
inspection of all exterior surfaces, including the floor immediately beneath them.
2. 603. A log of weekly inspections has been developed and implemented. A copy of the log has been
included for your review.
3. The Return to Compliance Certification was completed.
4. The Consolidated Emergency Response / Contingency Plan has been completed and implemented.
Copy attached.
5. The personnel training records have been relocated to the store. Copy attached.
The above mentioned documents are at the store now and you should have your copy either Tuesday or
Wednesday of this week as they went out to you on Friday.
Please let me know if you have any questions.
Thank you,
Tom
11/22/2011
NOV 20 2011
SAN JOAQUIN COUNTY
ENVIRONMENTAL
HEALTH DEPARTMENT
