W <br />California Regional Water Quality <br />Central Valley Region <br />.in H Hickox <br />Secretaryfor <br />Environmental <br />Protection <br />11 December 2000 <br />Mr Bob Cochran <br />Chevron Products Co <br />PO Box 6004 <br />San Ramon, CA 94583 <br />w4 <br />Control Board q. <br />C , <br />Sacramento Main Office <br />Internet Address httpJ/www swrcb ca gov/rwgcb5 <br />3443 Routier Road, Suite A, Sacramento, California 95827-3003 <br />Phone (916) 255-3000 - FAX (916) 255 3015 <br />lvern and Roger Baffoni <br />1175 Orangewood Drive <br />Lodi, CA 95240 <br />Gray Davis <br />Governor <br />SECOND NOTICE OF VIOLATION, CLEANUP AND ABATEMENT (C&A) ORDER NO. 5-00-704 <br />FORMER CHEVRONSTA TION #9-5 775,301 WEST KETTLEMAN LANE, LODI, SANJOAQUIN COUNTY <br />A Notice of Violation (NOV) was issued to Chevron Products Company (Chevron) on <br />22 September 2000 for failure to comply with C&A Order No 5-00-704 due to an incomplete Problem <br />Assessment Report and failure to stabilize your on-site MtBE-impacted groundwater plume In our <br />letter, you were given a time extension from 22 September to 4 December 2000 to complete your soil <br />Wd groundwater assessment, install additional monitoring wells, complete an aquifer test, and submit a <br />mplete Problem Assessment Report/Final Remediation Plan (PAR/FRP) Failure to submit the <br />required PAR/FRP is a violation of the C&A, Order Nos 4 and 5 <br />On 12 October 2000, Board staff, Chevron, Secor International Incorporated (Secor) met to discuss the <br />NOV and future work at the site You stated at our meeting that the 4 December 2000 date for the <br />PAR/FRP submittal would be difficult to meet due to problems gaining access agreements and securing <br />drilling companies for the work From the 12 October 2000 meeting to the present, you have installed <br />and brought online a third groundwater extraction well, completed an aquifer test, and applied for access <br />to install a sentinel well on the Tokay Shell property, 420 West Kettleman Lane Board staff <br />documented these efforts <br />On 16 November 2000, Board staff received your Request for Extension of Revised Problem Assessment <br />Report/Final Remediation Plan Deadline and Well Installation Update (Extension Request) submitted <br />on your behalf by Secor, for the subject site Chevron requested a second extension of time, of 74 -days, <br />from 4 December 2000 to 16 February 2001, to secure access agreements and install nine monitoring <br />wells both on-site and off-site, analyze soil and groundwater data, and submit a complete Problem <br />Assessment Report/Final Remediation Plan We will not agree to a further extension of compliance <br />dates at this time However, based on the complications that you have encountered during this <br />investigation, and the work completed on the site to date, staff will not recommend enforcement action if <br />you complete the work required in our 22 September 2000 letter forthwith, and submit the required <br />reports Until then this letter will serve as a second NOV regarding this matter <br />din 6 December 2000, Board staff contacted Ms Karen Diepenbrock, the attorney representing the <br />property owners of the Tokay Shell Ms Diepenbrock agreed to send access agreements to Secor for <br />Cattfornia Environmental Protection Agency <br />VD%� <br />
