FItICEIVED <br /> FEB 1 1 2016 <br /> ENVIRONMENTAL HEALTH <br /> DEPARTMENT <br /> Item#104: <br /> Union Pacific directs all emergency communications through its Response Management Communications <br /> Center(RMCC). The RMCC is staffed 24 hours per day, seven days per week with communication <br /> professionals that have been trained to notify relevant federal, state and local emergency response <br /> authorities, as appropriate, and to dispatch the Railroad's emergency response resources as necessary. <br /> This infrastructure is utilized throughout the Railroad's system, which encompasses hundreds of facilities <br /> within an infrastructure of 32,000 miles in 23 states. It is also sanctioned by federal, state and local <br /> authorities, including most jurisdictions within the State of California. To the extent that the Railroad's <br /> system deviates from the explicit wording of the local requirement, we believe it accomplishes the <br /> objective of the local requirement in a way that provides consistentcy throughout the Railroad's 32,000 <br /> mile infrastructure; and to the extent the local requirement is inconsistent, we believe it is preempted by <br /> the Interstate Commerce Termination Act of 1995, 49 U.S.C. 10501. This exercise of federal preemption <br /> authority does not mean Union Pacific will violate state and local requirements that are designed to <br /> protect human health and the environment. It simply means that an alternative method will be utilized to <br /> meet those requirements in a way that does not burden interstate commerce. <br /> Item#109: <br /> Manifests 012422085JJK, 012423729JJK and 010192669JJK were re-submitted by GHD Associates to <br /> DTSC, on behalf of Union Pacific. Copies of the final manifests are included as Attachment 6. <br /> Item#301. <br /> On January 21, 2016, the oil observed to be leaking from the air compressor was sampled and a waste <br /> determination was completed by Union Pacific contractor Arcadis (Attachment 7). The oily material from <br /> the compressor unit was sampled and has been determined to be a non-hazardous waste. The oily solids <br /> have been containerized in a drum and will be scheduled for proper disposal. The compressor unit has <br /> been identified as a bad order and is scheduled for removal and will be returned to the manufacturer. <br /> Item#303: <br /> The fire extinguishers were tested and replaced as necessary to assure proper operation in time of <br /> emergency.
