According to the SPCC Plan, filters are located inside the storm drains around the diesel tanks; no filters were observed in the tanks. The Spill Prevention, Control, and Countermeasure (SPCC) Plan must be amended when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge, within 6 months of the change, and implemented as soon as possible, not later than 6 months following preparation of the amendment. Immediately make all necessary amendments to the SPCC Plan to accurately represent the procedures and policies currently in place at the facility. This is a repeat violation, Class II. 613 CFR 112.7(e) Failed to conduct inspections or maintain records for 3 years. Copies of inspection and testing records for the SPCC Plan were not found on site. Inspections and tests must be conducted in accordance with the written procedures developed in the Spill Prevention, Control, and Countermeasure (SPCC) Plan. Records of these inspections and tests must be signed by the appropriate supervisor or inspector and kept on site with the SPCC Plan for a period of three years. Immediately locate a copy of all inspection and testing records for the last three years, maintain them on site, and submit copies to the EHD. This is a Class II violation.
