The 1,000 gallon elevated tank which was used to store diesel at on point is not in use but has not been properly closed. When a tank is not in use, it must be permanently closed by meeting the following conditions: -remove all liquid and sludge from each container and connecting line -disconnect and blank off all connecting lines and piping have from the tank -close and lock all valves -post a sign conspicuously stating that it is a permanently closed container and denoting the date of closure. Immediately"Permanently Close"all tanks that are not being used or amend the Spill Prevention, Control, and Countermeasure Plan to include all petroleum tanks that have not been permanently closed. This is a minor violation. 203 CFR 112.3 Failure to implement the SPCC Plan. The SPCC plan calls for a sign notifying drivers that they are required to completely disconnect all fuel oil transfer lines prior to departing from the unloading area. Facility personnel stated that sign was not in place.The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan"or"Plan")," in accordance with§ 112.7 and any other applicable section of this part. Immediately implement the plan as written or amend the plan to reflect actual practices and procedures. This is a minor violation. 301 CFR 112.5(a) Failed to amend Plan as necessary. The mobile refuelers are no longer parked in the location described in the SPCC plan. The Spill Prevention, Control, and Countermeasure(SPCC) Plan must be amended when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge,within 6 months of the change, and implemented as soon as possible, not later than 6 months following preparation of the amendment. Immediately make all necessary amendments to the SPCC Plan to accurately represent the procedures and policies currently in place at the facility. This is a minor violation.
