SPCC Plan failed to address disposal methods for recovered materials. Plan does not discuss how <br /> materials are recovered and how it would be properly disposed. Correct by addressing the proper <br /> methods of disposal of recovered materials in accordance with applicable legal requirements in <br /> accordance to California Code of Regulations, Title 22, Hazardous Waste Regulations. <br /> #24. SPCC Plan failed to include required contact list and current phone numbers for facility's clean up <br /> contractors and local agencies. Contact list is missing the required emergency contacts. Phone numbers <br /> is not current for SJC Office of Emergency Services and SJC EHD. Contact list and phone numbers for <br /> facility response coordinator, National Response Center, cleanup contractors with whom you have an <br /> agreement for response, and all appropriate Federal, State, and local agencies who must be contacted <br /> in case of discharge. Correct by updating the emergency contact list. <br /> # 17/ 50. Failed to install and regularly test approved liquid level sensing devices or provide equivalence <br /> as allowed by CFR 112.7(a)(2). Many of the tanks located in the tank farm do not have any form of liquid <br /> level sensing device approved under CFR 112.8(c)(8) and Plan does not state that they are regularly <br /> tested to ensure proper operations. For example, the dual diesel and gasoline, 500 gallon each, is <br /> equipped with an overfill prevention valve in the the spill containment above the tank that would satisfy <br /> as a high liquid level pump cutoff device set to stop flow at a predetermine container content level. <br /> Engineer or update each container installation in accordance with good engineering practice to avoid <br /> discharges. Correct by submitting a statement how this will be conducted. Should the installation of <br /> approved liquid level sensing devices does not seem practicable, the Plan must state reasons for <br /> nonconformance and describe in detail alternative methods and how equivalent environmental <br /> protection will be achieved. <br /> Submit to SJC EHD within 30 days (01/10/2011): <br /> 1. one copy of the completed "Return to Compliance Certification" form <br /> 2. a written corrective action statement for the above violations <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($122). <br /> THIS FACILITY IS SUBJECT TO REINSPECTIO T ANY TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD Inwectm Receive y: Title: <br /> � 1 <br /> EHD 23-02-003 Rev 10/10 C&TW&TION FORM <br />
