The Spill Prevention, Control, and Countermeasure (SPCC) Plan is not current: Section 1.1.1 of page 1 of the SPCC Plan which was last reviewed on 8/26/2010, requires certification of compliance for the proposed modification (page vi), this certification was not provided in the SPCC Plan. A review and evaluation of the plan must be conducted at least once every 5 years. Submit the missing certification of compliance to EHD and retain a copy within the SPCC Plan, or amend the SPCC Plan if the proposed modification is not followed. This is a Minor Violation. Note for future reference: You must document your completion of the review and evaluation, and must sign a statement as to whether you will amend the Plan, either at the beginning or end of the Plan, or in a log or appendix to the Plan. The following words will suffice: "I have completed the review and evaluation of the SPCC Plan for (name of facility) on (date), and will (will not) amend the Plan as a result." Be sure to amend the SPCC Plan to include all necessary documentation of the Plan reviews and ensure that future Plan reviews are properly documented. 713 CFR 112.8(c)(6) Failed to perform scheduled tank tests and inspections by appropriately qualified personnel. Failed to retain records of monthly inspection of the ASTs, piping, and pond for at least 3 years as required under the SPCC Plan(Page 14). Comparison records and other records of inspections and tests must be maintained on site. Immediately conduct the necessary inspection and submit a copy of the inspection record to the EHD. This is a Minor Violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by December 7, 2014.
