This facility has an Aboveground Petroleum Storage Act(APSA)regulated shell capacity greater than 10,000 gallons. A Spill Prevention, Control, and Countermeasure(SPCC) Plan was not available on site. All facilities which have an APSA regulated shell capacity of 1,320 gallons or greater shall prepare a written SPCC Plan which meets all of the requirements of the 40 CFR Part 112. This plan shall be certified by a professional engineer in accordance with 40 CFR 112.3(d). Immediately prepare a SPCC Plan in accordance with 40 CFR Part 112,which that includes all aboveground petroleum storage containers 55 gallons or larger. Submit a copy of the Professional Engineer (PE)certified SPCC Plan to the EHD for review. (This copy will be returned to the facility after review.) A copy shall be maintained on site at all times. This is a repeat violation, Class II. 103 HSC 25270.6(a) Failed to file HMBP or annual facility tank statement. The facility stated"no,"on the business activities page on CERS, and did not make an APSA submittal. A tank facility statement or business plan has not been submitted.A tank facility statement identifying the name and address of the tank facility, a contact person for the tank facility,the total storage capacity of the tank facility, and the location, size, age, and contents of each storage tank that exceeds 10,000 gallons in capacity and that holds a substance containing at least 5 percent of petroleum shall be submitted annually. Submittal of a business plan satisfies the requirement to submit a tank facility statement. Immediately submit a tank facility statement or business plan. This was corrected on site. This is a Class II violation. 106 CCR 25185(c)(3) Failed to submit a written response within 30 days of receiving an inspection report. An inspection was last done on November 15, 2013 and an inspection report was issued identifying information to be submitted to bring this site into compliance. The past violation includes"Failure to prepare a written SPCC Plan in accordance with CFR Part 112."This information was required to be submitted within 30 days. This information has not been received resulting in a non-compliant status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken. Ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, within 30 days of receipt of this report.
