The following is an itemized list of aboveground petroleum storage act violations that <br /> have not been addressed for CDCR-California Health Care Facility as of June 02, <br /> 2015. <br /> Open violations from September 04, 2014 inspection <br /> Violation #201 - Plan certification by a Professional Engineer(PE) missing or incomplete. <br /> The cumulative aboveground petroleum storage at this facility is 42,000 gallons. The Professional Engineer (PE) <br /> certification is incomplete: PE stamp, signature, date and registrations numbers are lacking. The PE certification <br /> must include all of the aspects in 40 CFR 112.3(d)(1), including attesting that the PE is familiar with 40 CFR Part 112 <br /> he or his agent has visited and examined the facility, the Spill Prevention, Control, and Countermeasure (SPCC) Plal <br /> has been prepared in accordance with good engineering practice, including consideration of applicable industry <br /> standards, procedures have been established for required inspections and testing, and the Plan is adequate for the <br /> facility. Immediately obtain a complete PE certification for the facility's SPCC Plan. Submit a copy of the completed <br /> certification to the EHD. This is a Class II violation. <br /> Violation #602 - Plan lacks approval of management to fully commit the necessary resources to implement <br /> the Plan. <br /> The management approval on page iv of the Spill Prevention, Control, and Countermeasure (SPCC) Plan is lacking. <br /> The SPCC must have the full approval of management at a level of authority to commit the necessary resources to <br /> fully implement the Plan. Immediately obtain required management approval for the SPCC Plan for this facility. This <br /> a Class II violation. <br /> Violation #604- No facility diagram or didn't show location and contents of containers,transfer stations, anc <br /> pipes. <br /> Facility's diagram included in the SPCC plan did not depict the existing inter facility connecting pipes associated with <br /> the onsite above ground petroleum storage. The Spill Prevention, Control, and Countermeasure (SPCC) Plan shall <br /> include a facility diagram which must mark the location and contents of each fixed storage container and the storage <br /> area where mobile or portable containers are located. It must identify the location of and mark as"exempt" <br /> underground tanks. It must also include all transfer stations and connecting pipes, including intra-facility gathering <br /> lines. Immediately update the facility diagram to include all of the required information. Submit a legible copy of the <br /> updated facility diagram to the EHD for review. This is a Class II violation. <br /> Violation#609 - Failed to provide secondary containment, diversionary structures, or equipment to prevent <br /> discharge. <br /> The SPCC plan failed to describe the secondary containment provisions for the above ground piping observed at the <br /> facility during the inspection; this piping appears to connect all existing above ground petroleum storage tanks locate <br /> adjacent to the"paralleling gear building". A facility shall provide appropriate containment and/or diversionary <br /> structures or equipment to prevent a discharge. The entire containment system, including walls and floor, must be <br /> capable of containing oil and must be constructed so that any discharge from a primary containment system will not <br /> escape the containment system before cleanup occurs. Immediately provide adequate secondary containment for a <br /> aboveground petroleum storage containers larger than 55 gallons. <br /> Violation #702 - Failed to design facility drainage system from undiked areas to retain in the facility. <br /> The SPCC plan did not provide an adequate description of drainage associated with drainage to "bare soil" noted in <br /> Table 4-1: Potential Spills. Drainage systems from undiked areas with a potential for a discharge shall be designed t <br /> flow into ponds, lagoons, or catchment basins designed to retain oil or return it to the facility. If the drainage system <br /> is not designed this way, then the final discharge of all ditches in the facility shall be equipped with a diversion systen <br /> that would retain oil at the facility. Immediately provide adequate description and design the facility's drainage <br /> systems to comply with this section and amend the Spill Prevention, Control, and Countermeasure Plan as <br /> necessary, or provide equivalence as allowed by CFR 112.7(a)(2).This is a Class II violation. <br /> Page 1 of 2 <br />
