Miner, Stockton Program: APSA <br /> SUMMARY OF VIOLATIONS <br /> CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> This is a routine Aboveground Petroleum Storage Act (APSA) inspection at the referenced facility. <br /> Facility has a shell capacity of at least 16,640 gallons. The following Minor violations - Notice to Comply <br /> were observed: 3,8,50 <br /> 3. Facility failed to file annual tank facility statement. <br /> - Tank facility shall file annual tank facility statement that shall identify the name and address of the <br /> tank facility, a contact person, the total storage capacity, the location/size/age/contents of each storage <br /> tank >10,000 gallons in capacity that holds at least 5% petroleum. A copy of a statement submitted <br /> previously may be submitted in lieu of a new statement if no new or used tanks have been added, or if <br /> no significant modifications have been made. <br /> * Submit a tank facility statement as described above, and continue annually thereafter. <br /> 8. Spill Prevention Control Countermeasure (SPCC) Plan did not include 150-gallon red diesel tank, and <br /> two empty approximately 750-gallon diesel tanks (one by the 2,100-gallon red diesel tank and the other <br /> on stilts on the west side of the property). <br /> - SPCC Plan must be amended when there is a change in the facility design, construction, operation, or <br /> maintenance that materially affects its potential for a discharge. Examples of changes are: <br /> commissioning or decommissioning containers; replacement, reconstruction, or movement of containers; <br /> reconstruction, placement, or installation of piping systems; construction or demolition that might alter <br /> secondary containment; changes of product or service; or revision of standard operation or maintenance <br /> procedures. <br /> * Amend SPCC Plan with the correct information and any other changes to the facility. <br /> 50. No liquid level sensing devices in the 2,100-gallon red diesel tank and the 150-gallon red diesel tank. <br /> - Bulk storage containers must be provided with at least one of the following devices: <br /> . High liquid level alarms with an audible or visual signal at a constantly attended operation or <br /> surveillance station. <br /> High liquid level pump cutoff devices set to stop flow at a predetermined container level. <br /> Direct audible or code signal communication between the container gauger and the pumping station. <br /> A fast response system for determining the liquid level such as digital computers, telepulse, or direct <br /> vision gauges. If you use this alternative, a person must be present to monitor gauges and the overall <br /> filling of bulk storage containers. <br /> If a liquid level sensing device is used, it must be tested regularly. <br /> * Provide the above containers with at least one of the above devices, and tested regularly if a liquid <br /> level sensing device is engineered. <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($122). <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD Inspector: '^ Received By.
