Each aboveground <br /> container shall be tested and inspected for integrity on a regular schedule and whenever repairs are made. The <br /> qualifications of personnel performing tests and inspections,frequency and type of testing and inspections that take <br /> into account container size, configuration, and design shall be determined in accordance with industry standards. <br /> Examples of these integrity tests include, but are not limited to:visual inspection, hydrostatic testing, radiographic <br /> testing, ultrasonic testing, acoustic emissions testing, or other systems of non-destructive testing. Comparison <br /> records and other records of inspections and tests must be maintained on site. Include a discussion of the industry <br /> standard(s)considered appropriate for the tanks at described in the SPCC Plan , or provide equivalence as allowed <br /> by CFR 112.7(a)(2). <br /> This is a Class II violation. <br /> 4010 The SPCC Plan did not contain "ATTACHMENT C-11—CERTIFICATION OF THE APPLICABILITY <br /> OF THE SUBSTANTIAL HARM CRITERIA"of CFR part 112. If the facility does not meet the substantial harm <br /> criteria listed in Attachment C-1 of CFR part 112, the owner or operator shall complete and maintain at the facility <br /> the certification form contained in Attachment C-11 to this appendix. In the event an alternative formula that is <br /> comparable to the one in this appendix is used to evaluate the substantial harm criteria,the owner or operator shall <br /> attach documentation to the certification form that demonstrates the reliability and analytical soundness of the <br /> comparable formula and shall notify the Regional Administrator in writing that an alternative formula was used. <br /> Complete"ATTACHMENT C-11—CERTIFICATION OF THE APPLICABILITY OF THE SUBSTANTIAL HARM <br /> CRITERIA"and provide a copy to the EHD. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork by January 13, 2019. <br /> Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate ($152).
