The following are Class II (Repeat) Violations, 301,404,605, and Minor - Notice to Comply: 101,108,125,126,128,407,603,701,804,812 101. This facility's EPA ID number is inactive. A hazardous waste generator shall not treat, store, dispose of, transport or offer for transportation, hazardous waste without an EPA ID number. Immediately contact DTSC reactivate your EPA ID number. Submit evidence to the EHD by 11/22/2011. 108. -- Seven 55-gallon drums of metal fines from baghouse for the willabrator require size and hazarous properties determination, and metal fines from the same baghouse had been sent to Allied Waste without first determining particle size or hazardous properties according to generator. -- Paint filters from paint booths had been disposed to trash bin in the past according to generator. -- Paint dusts in paint booths require hazardous waste determination. -- Absorbents in 2 trash cans in the metal and fab shops -- Metal shavings in trash can in metal shop. (Corrected on site.) Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop sending metal fines Allied Waste; first make a hazardous waste determination for the metal fines, and manage it according the Title 22 hazardous waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the metal is determined to be a hazardous waste. Immediately make a hazardous waste determination of the above paint filters, paint dusts, absorbents, and metal shavings accordingly, or dispose of the waste as hazardous waste in accordance to California Code of Regulations (CCR) Title 22. Submit a statement and supporting documentation explaining how this waste was managed by 11/22/2011. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
