Mosbacher <br /> ACCOMPANIED BY: Louis Pratt <br /> On 2 February 1994, I performed an inspection of the DeGroot and Sons property. Louis Pratt from our <br /> office accompanied me during my inspection. Louis received a telephone complaint alleging there was a <br /> discharge of cheese whey and wash water going to the drainage ditch from the DeGroot whey ponds. <br /> OBSERVATIONS AND COMMENTS: <br /> The following observations were made during this inspection: <br /> • The whey and wash water pond on the east side of Airport Road was full and appeared to be at <br /> minimum freeboard limits of two feet. No discharge appeared to have occurred from this pond. <br /> • The emergency whey and wash water pond on the west side of Airport Road was full, had no <br /> freeboard, and there were visible signs of recent spillage to the drainage ditch adjacent and south of <br /> the pond. <br /> • The confined animal facility on the Degroot property and adjacent the emergency pond was spilling <br /> large amounts of manured waste into the drainage ditch along the south side of the corral. Runoff <br /> from the corral was also entering into the emergency whey/wastewater pond. <br /> • The weather was dry and the last rainfall event occurred a month earlier. <br /> Whey and wash water discharges to surface waters are a violation of DeGroot's Waste Discharge <br /> Requirements Order No. 91-161's Discharge Prohibitions A.1 and A.2, which states: <br /> A.1 Discharge of wastes to surface waters or surface water drainage courses is prohibited. <br /> A.2 Bypass or overflow of treated or partially treated waste is prohibited. <br /> Use of the emergency whey and wash water holding pond, especially since insignificant amounts of <br /> rainfall has occurred, is a violation of Discharge Specifications B.7, B.10 and B.11, which state <br /> respectively: <br /> B.7 The wastewater shall be confined to the designated disposal area as delineated in <br /> Attachment A. <br /> B.10 Ponds shall have sufficient capacity to accommodate allowable wastewater flow and design <br /> seasonal precipitation and ancillary inflow and infiltration during the nonirrigation season. <br /> Design seasonal precipitation shall be based on total annual precipitation using a return <br /> period of 100 years, distributed monthly in accordance with historical rainfall patterns. <br /> Freeboard shall never be less than 2 feet(measured vertically). <br /> REVIEWED BY: <br />
