Failed to determine if a waste is a hazardous waste: <br />At time of inspection, oil was seen in the secondary containment spill pallet under 3 55 gallon drums of <br />oil. It was unknown if this was a waste or not. Immediately make a hazardous waste determination per <br />Title 22 regulations and handle accordingly or handle as hazardous waste. Within 30 days, provide <br />written documentation to this office describing what action was taken. <br />8. This facility's EPA ID number is inactive. A hazardous waste generator shall not treat, store, dispose <br />of, transport or offer for transportation, hazardous waste without an EPA ID number. Immediately <br />contact DTSC and reactivate your EPA ID number and submit evidence to the EHD by June 28, 2011. <br />A form has been provided. <br />52. At the time of inspection, it could not be demonstrated (not necessarily documented) that employees <br />who handle hazardous waste were properly trained. Both Travis Horton, terminal manager and Bill <br />Wardell, district operations manager, stated hazardous waste training was not provided to them. The <br />generator must ensure that all employees who handle hazardous waste are thoroughly familiar with <br />proper waste handling and emergency procedures. Immediately provide training to all employees who <br />handle hazardous waste and submit a copy of the training records to the EHD by June 28, 2011. <br />60 & 63. Copies of hazardous waste disposal records for 2008, 2009, 2010, 2011 were not found on <br />site. Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility <br />and all receipts used in a consolidated manifesting procedure on site for three years and have them <br />readily available for review. Immediately locate a copy of all manifests and receipts for the last three <br />years, maintain them on site, and submit copies to the EHD by June 28, 2011. Note: According to test <br />results for secondary containment done on Sept. 22, 2010 at this facility, 200 gallons of contaminated <br />test water was put into drums and left on site.
