A <br />55-gallon red steel drum of used oil was observed in the appliance recycling area with an incorrect accumulation start <br />date of 4/29/15. According to disposal records and Mr. Zeiter, this drum was last emptied on 6/11/15. The date was <br />corrected at the time of inspection. All hazardous waste containers shall be marked with the following information: <br />- the words "Hazardous Waste" <br />- name and address of generator <br />- hazardous properties (ignitable, corrosive, reactive, toxic) <br />- physical state (liquid, solid) <br />- composition (contents) <br />- accumulation start date <br />Immediately label these containers and ensure that all containers are marked with all the required information. Since <br />it cannot be determined how long the saturated oily absorbent pads have been on site, immediately contact a licensed <br />hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD. <br />This is a repeat violation, Class ll. <br />3010 <br />HSC 25211.3 Failed to keep complete records of appliance recycling. <br />The facility did not have complete records of their own on site appliance recycling. The records on site included <br />disposal records for some of the wastes and the number and type of appliances processed. No other records were <br />available for on site appliance recycling activities. Certified appliance recyclers must retain records for at least 3 years <br />that demonstrate compliance with applicable requirements. The records shall include, but not be limited to, all of the <br />following information: <br />- The amount, by volume or weight or both of each material that required special handling. <br />- The method used by the appliance recycler to recycle, dispose of, or otherwise manage each material that required <br />special handling, including the name and the address of the facility to which each material was sent. <br />- The number and types of appliances from which materials that require special handling are removed each year. <br />- The reports required pursuant to subdivision (c) of Section 25211.2. <br />Immediately locate these records, maintain them on site for 3 years, and submit a copy to the EHD. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by August 9, 2015. <br />Note: The routine hazardous waste generator inspection and the certified appliance recycler (CAR) were both <br />conducted today. <br />Please be aware as of January 1, 2013, all businesses are required to submit all hazardous materials information <br />online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov.
