Management of Used Oil Filters. <br /> History <br /> Notes <br /> (a) Used oil filters are to be managed as hazardous waste unless <br /> the conditions of one of the following paragraphs are met: <br /> (1) The filters are characterized as being nonhazardous using <br /> procedures identified in this division and applicable waste <br /> characterization procedures found in federal regulations or; <br /> (2) The conditions of subsection (b) of this section are met and <br /> the filters are managed in compliance with the requirements of <br /> subsection (c) of this section or; <br /> (3) The filters are generated by persons maintaining their own <br /> place of residence (i.e. , household waste) and such filters are <br /> taken to a collection location (such as a service station, parts <br /> retailer, household waste collection location, etc. ) or picked-up <br /> by a curbside collection system and transferred for purposes of <br /> recycling. The filters must be contained after their initial <br /> acceptance or collection so as to capture used oil that may <br /> separate from them. Upon reaching a location where proper <br /> drainage is practical, the filters shall be managed in accordance <br /> with subsection (c) of this section. <br /> (b) For the purposes of subsection (c) of this section, "used <br /> oil filters" are defined as filters which contain a residue of <br /> used oil (as defined in Health and Safety Code Section <br /> 25250 . 1 (a) ) and which are exempt from regulation as a hazardous <br /> waste under the scrap metal provision found in federal law (40 <br /> CFR Section 261. 6 (a) (3) (iv) ) . <br /> (c) In accordance with subsection (a) of this section, used oil <br /> filters that meet the conditions of subsection (b) of this <br /> section and are managed and recycled in compliance with the <br /> following requirements shall not be regulated as hazardous waste. <br /> (1) The filters are drained of free-flowing used oil. For the <br /> purposes of this subsection, free flowing is defined as a <br /> continuous stream of oil exiting the filter when the filter is <br /> inverted. oil exiting drop by drop is not considered to be <br /> free-flowing. However, if the filter is equipped with a device <br /> (such as a rubber flap located just inside the filter opening) <br /> which impedes the drainage of used oil from the filter, that <br /> device shall be manipulated to allow the oil to exit the filter <br /> freely, or the filter punctured, crushed, opened, drained, or <br /> otherwise handled in a manner that will allow the used oil to <br /> exit the filter. <br /> (2) The drained used oil filters are transferred for the <br /> purposes of metal reclamation. <br />
