The manager stated that he has <br /> someone by the name of Cubanos come and pick up the absorbent once a week. The manager stated that he does <br /> not know what Cubanos does with the waste and that he probably throws it into the trash. Any person who <br /> generates a waste shall determine if the waste is a hazardous waste. Immediately make a hazardous waste <br /> determination for the absorbent, and manage it according the Title 22 hazardous waste regulations. If the waste is <br /> hazardous, submit a statement and supporting documentation explaining how this waste was managed. If the <br /> waste is non-hazardous, submit supporting documentation (lab results, or other form of hazardous waste <br /> determination)showing that the absorbent is non-hazardous. <br /> This is a minor violation. <br /> 104 CCR 66262.34(d)(2) No modified contingency plan. <br /> The modified contingency plan could not be produced for review while on site.The modified contingency plan <br /> needs to be located on site next to a telephone. If a non-modified contingency plan is going to be used ensure that <br /> the plan is on site. Submit a copy of the modified contingency plan to the EHD for review and submit a statement to <br /> the EHD once the plan is on site. <br /> This is a minor violation. <br /> 106 CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. <br /> At the time of inspection, it could not be demonstrated that employees who handle hazardous waste were properly <br /> trained. Oil was observed pooling around engines and the hazardous waste drums were open with oil staining <br /> around the base of the drum. In addition,the manager was not aware of labeling requirements and making <br /> hazardous waste determinations. <br /> The generator must ensure that all employees who handle hazardous waste are thoroughly familiar with proper <br /> waste handling and emergency procedures. Provide proof of training to the EHD for employees whose <br /> responsibilities include hazardous waste. <br /> This is a minor violation. <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> Copies of uniform manifests for the disposal of hazardous waste for the past year were not found on site for the <br /> used antifreeze and used oil. Hazardous waste generators shall retain copies of all manifests signed off by the <br /> disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them <br /> readily available for review.
