Joint inspection w/ US EPA <br />Walk-thru inspection w/US EPA representative conducted on 10/4/12. <br />Paperwork inspection conducted on 10/25/12. <br />Class II/ Repeat violation: 108 <br />108. Failed to determine if waste is a hazardous waste. Outside Building 875 Heavy Equipment are two <br />brown covered pallets that contains used lead acid batteries. Each used lead acid batteries are labeled <br />its own start accumulation date it became a waste on a piece of tape. On the inside lid of the pallet was a <br />green sticker labeled "Non -Hazardous Waste" for the used lead acid batteries. Lead acid batteries are <br />considered "Hazardous Waste" because they contain lead and sulfuric acid but when the used lead -acid <br />batteries are intact, they should be managed for recycling. Any person who generates a waste shall <br />determine if the waste is a hazardous waste. Immediately make a hazardous waste determination for the <br />used lead acid batteries, and manage it according the Title 22 hazardous waste regulations. Submit a <br />statement and supporting documentation explaining how this waste will be managed. <br />- Corrected on site.
